AN ORDINANCE TO ABANDON PORTIONS OF THE EASEMENTS
RETAINED IN THE FORMER RIGHTS -OF -WAY OF WEST 13TH AN�
STATE STREETS WITHIN THE CAMPUS OF PHILANDM-- COLLEGE, IN THE CITY OF LITTLE ROCK, ARKANSAS,
7 RIGHT -OF -WAY; AND FOR OTHER PURPOSES.

9 WHEREAS, a request was made to vacate and abandon portions of the easemenfhW4j4=,eihe
10 former right -of -way of West 13th Street and State Street within the college campus to allow for the
11 construction of new student housing, pursuant to the City's general police power authority under Ark.
12 Code Ann. § 14 -54 -104; and
13 WHEREAS, the Board has determined that the abandoning of this public right -of -way will not have
14 an adverse impact on the adjacent property owners nor the local traffic, and therefore, the easements
15 abandoned by this ordinance are no longer needed for corporate purposes;
16 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
17 OF LITTLE ROCK, ARKANSAS:
18 Section 1. The Board of Directors hereby releases, vacates, and abandons portions of the easements
19 specifically described as follows:

21 Part of the former 131h Street and State Street rights -of -way abandoned by City of Little
22 Rock Ordinance No. 16,324, being more particularly described as follows:

24 BEGINNING at the Southeast Corner of Block 222 of the Original City of Little Rock,
25 Pulaski County, Arkansas, thence Southwesterly along the West right -of -way line of
26 South Gaines 38.00 feet; thence Northwesterly, running parallel with the South line of
27 said Block 222, 333.00 feet; thence Northeasterly, running parallel with the West line of
28 said Block 222, 70.00 feet; thence Southeasterly, running perpendicular to the West line
29 of said Block 222, 33.00 feet to a point on the West line of said Block 222; thence
30 Southwesterly, along the West line of said Block 222, 32.00 feet to the Southwest corner
31 of said Block 222; thence Southeasterly, along the South line of said Block 222, 300.00
32 feet to the POINT OF BEGINNING, containing 13,708.1 square fee, or, 0.315 acres,
33 more or less.

35 Section 2. A copy of this ordinance, duly certified by the City Clerk, shall be filed in the real estate
36 records of the recorder of the Circuit Clerk in ex officio recorder of Pulaski County, Arkansas.
37 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
38 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or
39 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and

effect as if the portion so declared or adjudged to be invalid or unconstitutional were not originally a part
of the ordinance.
Section 4. Repealer. All laws, ordinances, resolutions, or parts of the same that are
inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
