5 HEIGHTS ADDITION IN THE CITY OF LITTLE ROCK, ARKANSAS;' ' } lwvl
6 AND FOR OTHER PURPOSES.
7 WHEREAS, a request was made to vacate and abandon a portion of the alley right -of -way
8 located in Block 16, Pulaski Heights Addition, pursuant to the City's general police power
9 authority under Ark. Code Ann. § 14 -54 -104; and
10 WHEREAS, the Board has determined that the abandoning of this public right -of -way will
11 not have an adverse impact on the adjacent property owners nor the local traffic, and therefore,
12 the right -of -way abandoned by this ordinance is no longer needed for corporate purposes, except
13 as otherwise noted below;
14 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF
15 THE CITY OF LITTLE ROCK, ARKANSAS:
16 Section 1. The Board of Directors hereby releases, vacates, and abandons a portion of the
17 alley right -of -way located in Block 16, Pulaski Heights Addition, which includes a strip of land
18 20 feet in width and 90 feet in length running South of Kavanaugh Boulevard, as public right -of-
19 way.
20 Section 2. The City specifically reserves the public utility and drainage easements within
21 the former right -of -way.
22 Section 3. A copy of this ordinance, duly certified by the City Clerk, shall be filed in the
23 real estate records of the recorder of the Circuit Clerk in ex officio recorder of Pulaski County,
24 Arkansas.
25 Section 4. Severability. In the event any title, section, paragraph, item, sentence, clause,
26 phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such
27 declaration or adjudication shall not affect the remaining portions of the ordinance which shall
28 remain in full force and effect as if the portion so declared or adjudged to be invalid or
29 unconstitutional were not originally a part of the ordinance.
30 Section 5. Repealer. All laws, ordinances, resolutions, or parts of the same that are
31 inconsistent with the provisions of this ordinance are hereby repealed to the extent of such
32 inconsistency.
