AN ORDINANCE TO AMEND CHAPTER 20 OF THE LITTLE ROCK, ARK., ?;
REVISED CODE (1988) TO REDUCE THE NOTICE PERIOD FROM 30`x,
DAYS TO 15 DAYS FOR THE TIME ALLOWED BEFORE THE CITY
INITIATES THE PROCESS OF ABATEMENT FOR BUILDINGS AND
STRUCTURES DEEMED TO BE UNSAFE AND UNFIT FOR HUMAN
HABITATION WITHIN THE CITY OF LITTLE ROCK, ARKANSAS; TO
REDUCE THE TIMEFRAME IN WHICH ABANDONED OR BOARDED
BUILDINGS ARE BROUGHT UNDER CITY CONTROL SO THAT
REMEDIATION OR DEMOLITION CAN OCCUR; AND, FOR OTHER
PURPOSES.
13 WHEREAS, it has been determined that numerous buildings and structures within the City of Little
14 Rock, Arkansas have become abandoned, run -down, dilapidated, unsightly, dangerous, obnoxious, and
15 unfit for human habitation; and,
16 WHEREAS, the condition of these buildings and structures constitutes serious structural, fire, and
17 health hazards and are detrimental to the public welfare of the citizens of Little Rock; and,
18 WHEREAS, immediate action is necessary to bring these unsafe and abandoned structures under the

City's control so that remediation or demolition can occur; and,
WHEREAS, the existence of unsafe buildings and structures constitutes a public nuisance that must
be effectively abated by the City; and,
WHEREAS, City management requests an amendment to Article 11 to Chapter 20 of the Little Rock,
Ark., Rev. Code (1988) ( "LRC § 20 -28 ") that would reduce of the notice period allowed before the City
initiates abatement of unsafe buildings and structures;
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
OF LITTLE ROCK, ARKANSAS:
Section 1. Chapter 20- 28(a)(5) of the Little Rock, Rev. Code (1988), entitled "Nuisances," is hereby
amended to read as follows:
Sec. 20 -28. Abatement notice and notice to vacate.
(a) Whenever the building official declares a building or stricture to be dangerous or unfit for
human habitation, he shall give notice to the owner of such declaration by placarding the
building or structure. The notice shall:

1 (5) Require that all necessary permits be secured and work commenced within fifteen (15)
2 days and continued to satisfactory completion within such time as the building official
3 determines.
4 Section 2. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
5 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or
6 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and
7 effect as if the portion so declared or adjudged to be invalid or unconstitutional were not originally a part
8 of the ordinance.
9 Section 3. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent
10 with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
