That the zoning classification of the following described property be changed 13 from PCD to Revised PCD: 14 Lot 1 Tract A, the Ranch Subdivision, City of Little Rock, Pulaski County, 15 Arkansas. 16 SECTION 2. That the approval of Lot 1 Tract A The Ranch Subdivision Revised Short -form PCD, 17 located at 16900 Cantrell Road (Z- 4343 -W) is subject to compliance with the following additional 18 conditions: 19 • That the preliminary site development plan /plat be approved as submitted, 20 including all staff comments and conditions as outlined in the Planning 21 Commission Agenda Staff Report in paragraphs D, E, F and including any 22 conditions indicated in the staff analysis in paragraph H and subject to 23 additional conditions imposed at the Planning Commission Public Hearing 24 as amended by the applicant. 25 • The approval for the shaved ice stand is limited to operation by the 26 Malmstorm family. 27 • The shaved ice stand is allowed on the property only from March through 28 September yearly. 29 SECTION 3. That the preliminary site development plan /plat be approved as recommended by 30 the Little Rock Planning Commission. 31 SECTION 4. That the change in zoning classification contemplated for Lot 1 Tract A The 32 Ranch Subdivision Revised Short-form PCD, located at 16900 Cantrell Road (Z- 4343 -W) is conditioned 33 upon obtaining a final plan approval within the time specified by Chapter 36, Article VII, Section 36 -454 34 (e) of the Code of Ordinances. That the map referred to in Chapter 36 of the Code of Ordinances of the City of Little Rock, Arkansas, and designated district map be and is hereby amended to the extent and in the respects necessary to affect and designate the change provided for in Section 1 hereof. SECTION 6. That this Ordinance shall not take effect and be in full force until the final approval of the plan. SECTION 7. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the ordinance. SECTION 8. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
