ORDINANCE NO. 20,158
3 AN ORDINANCE TO DISPENSE WITH COMPETITIVE BIDS; TO AWARD A
4 MAINTENANCE AGREEMENT TO MOTOROLA, INC., IN THE AMOUNT SIX
5 HUNDRED AND FORTY THOUSAND, THREE HUNDRED AND SIXTY -TWO
6 DOLLARS AND SIXTY CENTS ($640,362.60); TO AUTHORIZE THREE ADDI-
7 TIONAL ANNUAL EXTENSIONS OF THIS AGREEMENT AT THE DISCRE-
8 TION OF THE CITY MANAGER; TO DECLARE AN EMERGENCY; AND FOR
9 OTHER PURPOSES.

11 WHEREAS, THE City has utilized a Motorola system for its emergency communications, and it has
12 been necessary to have a maintenance agreement for the system infrastructure which includes portable
13 and mobile radios used by the Little Rock Police Department; and,
14 WHEREAS, the last ordinance to award the maintenance contract to Grace Communications Com-
15 pany of North Little Rock, the only communications company in the central Arkansas are which has the
16 trained personnel, proprietary software, and test equipment readily available to property maintain the
17 City's radio network infrastructure and is the local service provider for Motorola, Inc; and,
18 WHEREAS, the last such contract for this service was authorized in Little Rock, Ark., Ordinance
19 No. 19,643 (November 21, 2006), and it is now time to enter into another agreement; and,
20 WHEREAS, as long as it can be certified to the City Manager that Grace Communications Company
21 of North Little Rock is the only local authorized dealer available to provide this service, then an annual
22 resolution upon recommendation of the City Manager should be sufficient for the renewal of this agree-
23 ment;
24 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
25 OF LITTLE ROCK, ARKANSAS:
26 Section 1. The City Manager is authorized to enter into a service agreement in the amount of six
27 hundred and forty thousand, three hundred and sixty -two dollars and sixty cents ($640,362.60), with
28 Grace Communications Company of North Little Rock to provide maintenance to the City's 800 mHz
29 radio system.
30 Section 2. Because of the need to have a local provider of these maintenance services authorized by
31 Motorola, Inc., and Grace Communications Company of North Little Rock is the only such provider, the
32 Board declares that it is impractical and unfeasible to submit this matter to a competitive bid process, and,
33 therefore, waives competitive bidding.

Section 3. As long as Grace Communications Company of North Little Rock is the only local pro-
viders of maintenance services for Motorola, Inc., equipment used by the City in its 800 mHz emergency
services equipment, an annual resolution to add another year to the agreement authorized by this Ordi-
nance, and to establish the consideration for such a contract, is all the legislative authority required, pro-
vided the City Manager certifies to the Board of Directors that there is no other local provider of this ser-
vices, and provided further than no such additional agreement will be for more than a one (1) year period
of time.
Section 4. Funds for the specific agreement authorized by this Ordinance are available in the City's
9 -1 -1- fund.
Section 5. Severability. In the event any portion of this ordinance is declared or adjudged to be inva-
lid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of this or-
dinance, which shall remain in full force and effect as if the portion so declared or adjudged invalid or
unconstitutional was not originally a part of this ordinance.
Section 6. Repealer. All ordinances and resolutions, and parts thereof, which are in conflict with any
provision of this ordinance are hereby repealed to the extent of such conflict.
Section 8. Emergency. The need to assure property maintenance of the 800 mHz emergency commu-
nication system at all times is crucial to protect the public health, safety and welfare; an emergency is,
therefore, declared to exist and this ordinance shall be in full force and effect from and after the date of
its passage.
