20156I ORDINANCE NO. 20,156 2 AN ORDINANCE TO CONDEMN CERTAIN STRUCTURES IN THE CITY 3 OF LITTLE ROCK AS STRUCTURAL, FIRE AND HEALTH HAZARDS; TO 4 PROVIDE FOR SUMMARY ABATEMENT PROCEDURES; TO DIRECT THE 5 CITY MANAGER AND CITY ATTORNEY TO TAKE SUCH ACTION AS IS 6 NECESSARY TO RAZE AND REMOVE SAID STRUCTURES; TO DECLARE 7 AN EMERGENCY; AND FOR OTHER PURPOSES. 8 WHEREAS, certain structures in the City of Little Rock, Arkansas, have become run -down, 9 dilapidated, unsightly, dangerous, obnoxious and detrimental to the public welfare of the citizens of Little 10 Rock; and 11 WHEREAS, the condition of these structures constitutes a serious structural, fire and health hazard; 12 and 13 WHEREAS, such structures are a public nuisance and are dangerous to the health and safety of the 14 occupants or other persons and, further, are in such condition as to be dangerous to the lives, limbs and 15 property of people in its vicinity or those lawfully passing thereby; and 16 WHEREAS; such structures are declared a nuisance and immediate action is necessary to remedy 17 these situations and said buildings should be rehabilitated by the owners or razed either by the owners or 18 the City of Little Rock; 19 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY 20 OF LITTLE ROCK, ARKANSAS. 21 Section 1. The Board of Directors hereby declares that the following structure constitutes a public 22 nuisance. The owner of the following described property is hereby ordered either to begin rehabilitation 23 by immediately contacting the Department of Housing & Neighborhood Programs and entering into an 24 agreement providing for the immediate rehabilitation of the structure or to raze and remove said structure 25 within twenty -four (24) hours and to complete such removal within seventy -two (72) hours of the 26 effective date of this Ordinance. While not required by law to do so, the Department of Housing & 27 Neighborhood Programs will immediately attempt to notify the owner of the property listed below of the 28 passage of this ordinance by certified mail or personal service. 29 The property on which the condemned structure is located by street address and legal description 30 is hereafter set forth with the name of the owner of record, as follows: 31 Willie Cooper 32 4001 Baseline Road 33 35L0013000600 34 Rinke Garden Acres, Block 0, Lot 4 [PAGE 1 OF 2] 1 Section 2. The conditions of the structure on the above - described property has been found to present 2 structural, fire and health hazards and are dangerous to the health and safety of the occupants or other 3 persons, and further, the structure is in such condition as to be dangerous to the lives, limbs and property 4 of people in its vicinity or those lawfully passing thereby. 5 Section 3. The City Manager and City Attorney is hereby authorized to institute such proceedings 6 against such persons as may be necessary in order to enforce the provisions of this ordinance so as to 7 remedy the unsightly and dangerous conditions brought about as a result of the failure of the owner 8 thereof to maintain this property. 9 Section 4. The Department of Housing and Neighborhood Programs of the City of Little Rock is 10 also authorized to raze and remove said building and file and enforce a lien against said property for the 11 cost of razing and removing said structure pursuant to Section 20 -32 of the Little Rock Code of 12 Ordinances. 13 Section 5. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 14 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or 15 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and 16 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the 17 ordinance. 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 Section 6. Repealer. All laws, ordinances, resolutions, or parts of the same, that are inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency. Section 7. Unless the provisions of this Ordinance are put into effect immediately, the public health, safety and welfare of the citizens of Little Rock will be adversely affected; therefore, an emergency is hereby declared to exist, and this ordinance shall be in full force and effect from and after its passage.
