PULASKI COUNTY CIRCUIT/COUNTY , ORDINANCE / 20,147 - WE TO APPROVE AS A PROJECT OF THE 2009 PARKS a & RECREATION CAPITAL IMPROVEMENT BOND FUNDS TO RE- 5 PAIR AND RESURFACE GREENS AT THE CHAMPIONSHIP COURSE 6 OF THE REBSAMEN PARK GOLF COURSE; TO PURCHASE COVERS 7 TO PROTECT THE GREENS; TO DISPENSE WITH THE REQUIRE - 8 MENT OF COMPETITIVE BIDS FOR THE COST TO RESURFACE THE 9 GREENS; TO DECLARE AN EMERGENCY; AND, FOR OTHER PUR- 10 POSES. 11 12 WHEREAS, the premier course at the Rebsamen Park Golf Course is the Championship 13 Course ( "the Course "); and, 14 WHEREAS, there is an extensive need for greens work on the Course, more particularly to 15 change from L -93 Bent grass to Ultra -dwarf Bermuda grass; and, 16 WHEREAS, there is an opportunity for the City to obtain a special price for the grass and 17 the rebuilding of the greens at the Course because of the concomitant changes that are being is made at the Pleasant Valley Country Club; and, 19 WHEREAS, it is imperative that these changes be made immediately so that the new greens 20 can take advantage of the warm weather which is essential for healthy greens with this type of 21 grass; and, 22 WHEREAS, it is also important to purchase covers for the greens at the Course to assure 23 that they will be maintained in the best condition possible during the winter months; and, 24 WHEREAS, it is important to approve this additional project as one to use bond monies au- 25 thorized by Little Rock, Ark., No. 20,119 (June 16. 2009); 26 WHEREAS, there are funds available to pay for such a capital improvement in the 27 $7,380,000 City of Little Rock, Arkansas, Capital Improvement Construction Revenue Bonds 28 (Zoo, Parks and Recreation Projects), Series 2009, as approved in Little Rock, Ark., Ordinance 29 No. 20,119 (June 16, 2009); 30 NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF LITTLE ROCK, AR- 31 KANSAS: [PAGE 1 OF 3] Ordinance to dispense with competitive bids to purchase greens for Rebsamen Golf Course; and, to create a bond project fund I Section 1. The City Manager is authorized to enter into a contract with Champion Turf 2 Farms in the amount of forty seven thousand dollars ($47,000.00), as the cost to convert the 3 greens at the Course at Rebsamen Park Golf Course from L -93 Bent grass to Ultra -dwarf Ber- 4 muda grass. 5 Section 2. Upon the selection of a vendor after a competitive process, the City Manager is 6 authorized to enter into a contract for the purchase of greens covers for the Championship 7 Course at the Rebsamen Park Golf Course. s Section 3. The total amount of bond funds to be used for these two purchases shall not ex- 9 ceed eighty thousand dollars ($80,000.00). 10 Section 4. The Board of Directors expressly finds that because of the repair of the Pleasant 11 Valley Country Club Golf Course the City has the opportunity to purchase the Ultra -dwarf Ber- 12 muda grass at such a substantially reduced price that it is impractical and unfeasible to make this 13 purchase pursuant to a competitive bid, and therefore the requirement for a competitive bid is 14 waived. 15 Section 4. Funds for the purchases are available from the $7,380,000 City of Little Rock, 16 Arkansas, Capital Improvement Construction Revenue Bonds (Zoo, Parks and Recreation Pro- 17 jects), Series 2009 bond accounts. 18 Section 5. Severability. In the event any title, section, paragraph, item, sentence, clause, 19 phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such 20 declaration or adjudication shall not affect the remaining portions of the ordinance which shall 21 remain in full force and effect as if the portion so declared or adjudged invalid or 22 unconstitutional were not originally a part of the ordinance. 23 Section 6. Repealer. All laws, ordinances, resolutions, or parts of the same, that are 24 inconsistent with the provisions of this ordinance are hereby repealed to the extent of such 25 inconsistency, particularly and not limited to the list of projects set forth in the recitals of Little 26 Rock, Ark., Ordinance No. 20,119 (June 16, 2009). 27 Section 7. Emergency Clause. The need to maintain attractive and competitive greens on a 28 municipal golf course is essential to the upkeep of the course and also to the desirability for the 29 public to use the course; the opportunity to make the purchase of Ultra -dwarf Bermuda grass at 30 a substantial savings is a desire of the City and its Parks & Recreation officials which will be 31 lost if immediate action is not taken; the fees for such use assist in the payment of the 2009 [PAGE 2 OF 31 Ordinance to dispense with competitive bids to purchase greens for Rebsamen Golf Course; and, to create a bond project fund I Parks & Recreation bonds; the need to approve these projects is essential to maintain proper 2 accounting for bonds fund and to comply with the provisions of Little Rock, Ark., Ordinance No. 3 20,119 (June 16, 2009); all of these things must be conducted in a manner that protects the 4 public health, safety and welfare; an emergency is, therefore, declared to exist and this 5 ordinance shall be in full force and effect from and after the date of its passage. 6 PASSED: August 18, 2009 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 TEST: usan Lag , cting City Clerk Mark Stodola, Mayor APPROVED AS TO LEGAL FORM: Thomas M.
