20146I ORDINANCE NO. 20,146 2 3 AN ORDINANCE TO DISPENSE WITH THE REQUIREMENT OF COMPETI- 4 TIVE BIDDING AND AUTHORIZE THE CITY MANAGER TO ENTER INTO A 5 CONTRACT WITH MOTOROLA, INC. FOR THE PURCHASE OF EIGHTEEN 6 (18) CONCURRENT USER LICENSES; AND FOR OTHER PURPOSES. 7 8 WHEREAS, a user survey of the City's 3 -1 -1 Customer Service System has determined that an addi- 9 tional eighteen (18) concurrent user licenses are necessary due to the number of actual users on the sys- 10 tem simultaneously; and 11 WHEREAS, competitive bidding should be waived and the contract for eighteen (18) additional user 12 licenses should be awarded to Motorola, Inc. as the sole source provider of the licenses, in order that 13 they will be compatible with those licenses currently in use by the 9 -1 -1 Center, and which were pur- 14 chased with the original contract with Motorola; 15 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY 16 OF LITTLE ROCK, ARKANSAS: 17 Section 1. The Board of Directors finds that competitive bidding should be dispensed with and 18 that the contract for the purchase of eighteen (18) user licenses for the 3 -1 -1 Customer Service Center 19 shall be awarded to Motorola, as an exceptional situation exists and competitive bidding is impractical 20 and infeasible. 21 Section 2. The City Manager is hereby authorized to dispense with competitive bidding and to 22 enter into a contract with Motorola, Inc. for the purchase of eighteen (18) user licenses, in the amount of 23 Eighty -eight Thousand, Five Hundred Sixty Dollars ($88,560.00), including all applicable taxes. 24 Section 3. Funds for this purchase are available from 9 -1 -1 fees. 25 Section 4. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, 26 or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or 27 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and 28 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the 29 ordinance. 30 Section 5. Repealer.
