201443 AN ORDINANCE TO AMEND CHAPTER 30 OF THE CODE OF ORDINANCES
4 OF THE CITY OF LITTLE ROCK, ARKANSAS, TO PROVIDE FOR A
5 DEFERRAL OF MASTER STREET PLAN CONSTRUCTION REQUIREMENTS
6 FOR HILARO SPRINGS ROAD; AND FOR OTHER PURPOSES.

8 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
9 OF LITTLE ROCK, ARKANSAS:
10 Section 1. That Chapter 30 of the Code of Ordinances is amended to provide for a deferral of certain
11 requirements within the Master Street Plan until the adjacent property along Hilaro Springs Road is
12 developed for Colwal Roth LLC at 9823 Hilaro Springs Road.

14 Subsection a. Chapter 30 Article VI requiring developers to construct roadway improvements
15 to the requirements of the Master Street Plan will be deferred for a period of five (5) years or until
16 adjacent development along Hilaro Springs Road occurs whichever occurs first. The specific
17 deferral is for improving Hilaro Springs Road as part of 9823 Hilaro Springs Road Short-form
18 Revised PD -I along the frontage of the property at 9823 Hilaro Springs Road to minor arterial
19 standards including widening, curb, gutter, sidewalk, access ramps, bridge improvements, and
20 street lights.

22 Subsection b. On Hilaro Springs Road, a 45 foot right of way dedication from centerline along
23 the frontage of the property at 9823 Hilaro Springs Road will be required prior to the issuance of
24 the certificate of occupancy.

Section 2. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or
adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and
effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the
ordinance.
Section 3. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent
with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
Section 4. This ORDINANCE shall take effect thirty � 30 ) days from and after its passage. .�`�
