Recorded in Official - • PULASKI COUNTY CIRCUITICOUNTY CLERK ORDINANCE I -- INANCE TO APPROVE A PLANNED ZONING DEVELOPMENT AND ESTABLISHING A PLANNED INDUSTRIAL DISTRICT TITLED 9823 HILARO SPRINGS ROAD REVISED SHORT - FORM PD -I (Z- 4790 -B), LOCATED AT 9823 HILARO SPRINGS ROAD, LITTLE ROCK, ARKANSAS, AMEND THE OFFICIAL ZONING MAP OF THE CITY OF LITTLE ROCK; AND FOR OTHER PURPOSES. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS. Section 1. That the zoning classification of the following described property is changed from PD -I to Revised PD -I: All that part of the East 3 /4ths of the SE 1/4 of the SW 1/4 of Section 5, T -1 -S, R -12 -W, Pulaski County, Arkansas, lying East of Hilaro Springs Right of way and North of the Chicago, Rock Island and Pacific Railroad Company Right of way which was abandoned on or about November 29, 1985. Containing 8.0 acres more or less. Subject to a utility easement along the 19 west line and drainage easement along the south and east lines. 20 Section 2. That the approval of 9823 Hilaro Springs Road Revised Short-form PD -I (Z- 21 4790 -13), located at 9823 Hilaro Springs Road is subject to compliance with the following 22 additional conditions: 23 That the preliminary site development plan/plat be approved as submitted, 24 including all staff comments and conditions as outlined in the Planning 25 Commission Agenda Staff Report in paragraphs D, E, F and including any 26 conditions indicated in the staff analysis in paragraph H and subject to additional 27 conditions imposed at the Planning Commission Public Hearing as amended by 28 the applicant. 29 Section 3. That the preliminary site development plan/plat is approved as recommended by 30 the Little Rock Planning Commission. 31 Section 4. That the map referred to in Chapter 36 of the Code of Ordinances of the City of Little Rock, Arkansas, and designated district map be and is hereby amended to the extent and in the respects necessary to affect and designate the change provided for in Section 1 hereof. Section 6. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the ordinance. Section 7. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
