NCE TO APPROVE A PLANNED ZONING DEVELOPMENT AND
ESTABLISH A PLANNED OFFICE DISTRICT TITLED C STREET SURGERY
CENTER SHORT -FORM PD -O (Z- 8445), LOCATED AT 5910 C STREET,
LITTLE ROCK, ARKANSAS, AMENDING THE OFFICIAL ZONING MAP OF
THE CITY OF LITTLE ROCK; AND FOR OTHER PURPOSES.

9 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
10 OF LITTLE ROCK, ARKANSAS:
11 Section 1. That the zoning classification of the following described property be changed from R -3,
12 Single - family to PD -O:
13 Part of Lot 16 of the Subdivision of the W 1/2 of the NW 1/4 of Section 6, T -1 -N, R -12 -W,
14 in the City of Little Rock, Pulaski County, Arkansas, more particularly described as
15 follows: Beginning 25 feet north and 211 feet east of the southwest corner of said Lot 16;
16 thence North, 194.8 feet; thence East, 51 feet; thence South 194.8 feet; thence west, 51
17 feet to the point of beginning.
18 AND
19 Part of Lot 16 of the Subdivision of the W 1/2 of the NW 1/4 of Section 6, T -1 -N, R -12 -W,
20 in the City of Little Rock, Pulaski County, Arkansas, more particularly described as
21 follows: Beginning 25 feet north and 262 feet east of the southwest corner of said Lot 16;
22 thence North, 194.8 feet; thence East, 51 feet; thence South 195.0 feet; thence west, 51
23 feet to the point of beginning.

ORDINANCE
To approve POD Z -8445
I Section 2. That the approval of C Street Surgery Center Short-form PD -O
2 (Z- 8445), located at 5910 C Street is subject to compliance with the following additional conditions:
3 • That the preliminary site development plan /plat be approved as submitted, including
4 all staff comments and conditions as outlined in the Planning Commission Agenda
5 Staff Report in paragraphs D, E, F and compliance and including any conditions
6 indicated in the staff analysis in paragraph H and subject to additional conditions
7 imposed at the Planning Commission Public Hearing as amended by the applicant.
8 • At the time of development the developer will supply a new culvert to replace the
9 existing damaged culvert located along C Street. The City will install the culvert
10 with City work forces and equipment. When construction is ready to begin, the
11 developer will request the City clean the existing ditches along C Street and Pierce
12 Street.
13 • All drainage from the proposed building and circular driveway will be directed to C
14 Street.
15 • The flume at the north end of the existing parking lot will be re- directed to the east
16 and into a vegetated swale running east -west along the north side of the proposed
17 surgery center building.
18 Section 3. That the preliminary site development plan/plat be approved as recommended by the

Little Rock Planning Commission.
Section 4. That the change in zoning classification contemplated for C Street Surgery Center Short-
form PD -O (Z- 8445), located at 5910 C Street is conditioned upon obtaining a final plan approval within
the time specified by Chapter 36, Article VII, Section 36 -454 (e) of the Code of Ordinances.
Section 5. That the map referred to in Chapter 36 of the Code of Ordinances of the City of Little
Rock, Arkansas, and designated district map be and is hereby amended to the extent and in the respects
necessary to affect and designate the change provided for in Section 1 hereof.
Section 6. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or
adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and
effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the
ordinance.
Section 7. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent
with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.

Section 8. That this Ordinance shall not take effect and be in full force until the final approval of the
plan.
