WHEREAS, a request was made to vacate and abandon sanitary sewer easements located within
Lots 1 -4, Block 7, Thalheimer's Subdivision of Glendale Addition, located at 4400 West Markham Street,
in the City of Little Rock, pursuant to the City's general police power authority under Ark. Code Ann. §
14 -54 -104; and
WHEREAS, the Board has determined that there is no public need for these easements, as the
existing sewer line will be relocated and a new easement will be dedicated;
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
OF LITTLE ROCK, ARKANSAS:
Section 1. The Board of Directors hereby releases, vacates, and abandons specific sanitary sewer
easements located within Lots 1 -4, Block 7, Thalheimer's Subdivision of Glendale Addition, located at
4400 West Markham Street, in the City of Little Rock, as set forth in Attachment "1" hereto.
Section 2. A copy of this ordinance, duly certified by the City Clerk, shall be filed in the real estate
records of the recorder of the Circuit Clerk in ex officio recorder of Pulaski County, Arkansas.
Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or
adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and
effect as if the portion so declared or adjudged to be invalid or unconstitutional were not originally a part
of the ordinance.
Section 5. Repealer. All laws, ordinances, resolutions, or parts of the same that are
inconsistent with the provisions of this ordinance are hereby repealed to the extent of such ' consistency.

ATTACHMENT "A"
A fifteen (15) foot wide easement lying 7.5' either side of and being parallel with and
adjacent to the following described centerline:
Part of Lot Four (4), Thalheimer's Subdivision of Block Seven (7), Glendale Addition to
the City of Little Rock, more particularly described as follows:
Commencing at the SE corner of Lot 4; thence North 18.0" along the East lot line to the
point of beginning; thence Westerly 47.0' to the point of termination that is 22.3' North
of the SW corner of said lot with parallel side of said easement extending to the property
lines, containing 706 square fee, more or less.
Part of Lot One (1), Thalheimer's Subdivision of Block Seven (7), Glendale Addition to
the City of Little Rock, more particularly described as follows:
Beginning at the SE corner of Lot 1; thence North 12.6' along the East lot line; thence
Westerly 47.0' to a point that is 16.9' North of the SW corner of said lot; thence South
16.9' along the West lot line to the SW corner of said lot; thence Easterly 47.0' along the
South lot line to the point of beginning, containing 694 square feet, more or less.
Parts of Lots Two (2) and Three (3), Thalheimer's Subdivision of Block Seven (7),
Glendale Addition to the City of Little Rock, more particularly described as follows:
Beginning at the SE corner of Lot 2; thence North 16.9' along the lot line; thence
Westerly 94.0' to a point that is 25.5' North of the SW corner of Lot 3; thence South
25.5' parallel to the lot line; thence Easterly 94.4' along the lot line to the point of
beginning, containing 1995 square feet, more or less.
The easement abandonment will not become effective until the existing sewer facilities
have been relocated from the abandoned easement areas and new easement(s) provided
for the new sewer lines.
