3 AN ORDINANCE TO DISPENSE WITH THE REQUIREMENT OF
4 COMPETITIVE BIDDING AND AUTHORIZE THE CITY MANAGER TO
5 ENTER INTO A CONTRACT IN THE AMOUNT OF TWO HUNDRED EIGHTY -
6 FOUR THOUSAND, FIFTY -EIGHT DOLLARS ($284,058.00) WITH SMART
7 PUBLIC SAFETY SOFTWARE AS THE SOLE SOURCE PROVIDER TO
8 UPGRADE THE POLICE RECORDS MANAGEMENT SYSTEM; AND FOR
9 OTHER PURPOSES.

1 1 WHEREAS, the current Police Records Management System was developed in 1991 and has been
12 upgraded, modified, and enhanced by the City's Office of Information Technology with programming
13 and hardware to meet the ever changing needs of the Police Department, and
14 WHEREAS, competitive bidding should be waived and the contract awarded to Smart Public Safety
15 Software, as the sole source provider to upgrade the Police Records Management System for the Police
16 Department, as Smart Public Safety Software is proprietary and no other vender can interface with the
17 Department's State - approved validation software.
18 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
19 OF LITTLE ROCK, ARKANSAS:
20 Section 1. The Board of Directors finds that competitive bidding should be dispensed with in the
21 upgrade of the Police Records Management System.
22 Section 2. The City Manager is hereby authorized to dispense with competitive bidding and to enter
23 into a contract with Smart Public Safety Software to upgrade the Police Records Management System in
24 the amount of Two Hundred Eighty -four Thousand, Fifty -eight Dollars ($284,058.00).
25 Section 3. Funds for this purchase are available from the Recovery Act Edward Byrne Justice
26 Assistance Grant of 2009.
27 Section 4. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
28 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or
29 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and
30 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the
31 ordinance.
32 Section 5. Repealer. All ordinances and resolutions, and parts thereof, which are in conflict with
33 any provision of this ordinance are hereby repealed to the extent of such conflict.
