AN ORDINANCE TO AMEND LITTLE ROCK, ARK., REVISED CODE § 2 -243
(1988) TO RECOGNIZE ABSTRACT AND REAL ESTATE TITLE SERVICES
AS A PROFESSIONAL SERVICE FOR THE CITY OF LITTLE ROCK,
ARKANSAS, AND FOR ITS VARIOUS BOARDS AND COMMISSIONS; AND
FOR OTHER PURPOSES.
WHEREAS, Ark. Code Ann. § 19- 11- 801(c)(West Supp. 2009), regarding the designation of professional
services, authorizes a political subdivision to include as professional services such consulting services as the
political subdivision shall designate by two- thirds (2/3) vote of its governing body, and
WHEREAS, the Board of Directors of the City of Little Rock, Arkansas, finds that price or cost bidding
for the provision of the services of an abstract and real estate title company is impracticable, unfeasible, or, if based
solely on price, would result in an outcome that would not meet the best interests of the City, and
WHEREAS, for the services of an abstract and real estate title company, this declaration on an ongoing
basis is appropriate.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF
LITTLE ROCK ARKANSAS:
Section 1. Little Rock, Ark., Rev. Code § 2- 243(a)(2) (1988) is hereby amended to add subsection (v) and
read as follows:
(2) All services declared to be a professional service if done for or on behalf of the City, its
boards, commissions or authorities, including the following:
(v) Abstract and real estate title services.
Section 3. Severability. In the event any portion of this ordinance is declared or adjudged to be invalid or
unconstitutional, such declaration or adjudication shall not affect the remaining portions of this ordinance, which
shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional was not
originally a part of this ordinance.
Section 4. Repealer. All ordinances and resolutions, and parts thereof, which are in conflict with any
provision of this ordinance are hereby repealed to the extent of such conflict.
30 Section 5. Emergency. The Board of Directors hereby determines that there is a need to obtain the
31 services of an abstract and real estate title company in order to deal with housing issues such as those
32 faced by the Little Rock Land Bank Commission, and that is in the best interests of the City for such
33 services to be secured through the request for qualifications process as soon as possible; therefore, an

emergency is hereby declared to exist, and this Ordinance being necessary for the public health, safety
