AN ORDINANCE APPROVING A MODIFICATION TO A
PLANNED ZONING DEVELOPMENT TITLED HEARNE
BUILDING SHORT -FORM PCD (Z- 5742 -B), LOCATED
AT 1001 WRIGHT AVENUE, LITTLE ROCK,
ARKANSAS, AMENDING ORDINANCE NO. 19,729
AND THE OFFICIAL ZONING MAP OF THE CITY OF
LITTLE ROCK; AND FOR OTHER PURPOSES.
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF
LITTLE ROCK, ARKANSAS.
SECTION 1. That Ordinance No. 19,729 passed on April 3, 2007, be amended
to provide for modification of the Planned Zoning Development described as C& G Asset
Management Short-form PCD;
SECTION 2. That the zoning classification of the following described property
be changed from PCD to Revised PCD:
Lots 11 and 12, Block 25, Weldon E. Wright's Addition to the City of Little
Rock, Pulaski County, Arkansas, and being shown on Plat of Record in
Deed Book M -2, Page 626, Records of Pulaski County, Arkansas. And All
that part of Wright Avenue, lying North of and being adjacent to Lot 12,

/� • passed on November 2, 1993, of records as instrument No. 94- 07454, filed

G part of Lots 10 and 11, Block 274, Fulk's Subdivision of Original City of
;, `i = Little Rock, Pulaski County, Arkansas lying south of the present right of
Q way for Wright Avenue, and being shown on Plat of Record in Deed Book
R' ' 29, Page 280, Records of Pulaski County, Arkansas.
ONTY
SECTION 3. That the approval of the Hearne Building Short-form PCD (Z-5742-
B), located at 1001 Wright Avenue is subject to compliance with the following additional
conditions:
• That the preliminary site development plan/plat be approved as submitted,
including all staff comments and conditions as outlined in the Planning
Commission Agenda Staff Report in paragraphs D, E, F and including any
conditions indicated in the staff analysis in paragraph H and subject to
additional conditions imposed at the Planning Commission Public Hearing
as amended by the applicant.
• The approval is limited to Dr. and Mrs. Archie Hearne and is not a
transferable approval.
• The uses of the site are limited to a medical office, coffee shop, art
bookstore /art gallery.
SECTION 4. That the preliminary site development plan/plat be approved as
recommended by the Little Rock Planning Commission.
SECTION 5. That the change in zoning classification contemplated for the
Hearne Building Short-form PCD (Z- 5742 -B), located at 1001 Wright Avenue is
conditioned upon obtaining a final plan approval within the time specified by Chapter 36,
Article VII, Section 36 -454 (e) of the Code of Ordinances.
SECTION 6. That the map referred to in Chapter 36 of the Code of Ordinances
of the City of Little Rock, Arkansas, and designated district map be and is hereby
amended to the extent and in the respects necessary to affect and designate the change
provided for in Section 2 hereof.
SECTION 7. That this Ordinance shall not take effect and be in full force until
the final approval of the plan.
SECTION 8. Severability. In the event any title, section, paragraph, item,
sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid
or unconstitutional, such declaration or adjudication shall not affect the remaining
portions of the ordinance which shall remain in full force and effect as if the portion so
declared or adjudged invalid or unconstitutional was not originally a part of the
ordinance.
SECTION 9. Repealer. All laws, ordinances, resolutions, or parts of the same
that are inconsistent with the provisions of this ordinance are hereby repealed to the
extent of such inconsistency.
