20031I ORDINANCE NO. 20,031 2 3 AN ORDINANCE TO APPROVE A PLANNED ZON- 4 ING DEVELOPMENT AND ESTABLISHING A 5 PLANNED COMMERCIAL DISTRICT ENTITLED 6 DAIRY LAND REVISED LONG -FORM PCD (Z -6318- 7 C), LOCATED ON THE SOUTHWEST CORNER OF 8 CHENAL PARKWAY AND KANIS ROAD, LITTLE 9 ROCK, ARKANSAS, AMENDING THE OFFICIAL 10 ZONING MAP OF THE CITY OF LITTLE ROCK; 11 AND FOR OTHER PURPOSES. 12 13 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DI- 14 RECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: 15 Section 1. The approval of Dairy Land Revised Long -form PCD (Z- 6318 -C), located 26 on the Southwest corner of Chenal Parkway and Kanis Road is subject to compliance 27 with the following additional conditions: 28 (a) The preliminary site development plan/plat shall be approved as submit - 29 ted, including all staff comments and conditions as outlined in the Plan - 30 ning Commission Agenda Staff Report in paragraphs D, E, F and includ- 31 ing any conditions indicated in the staff analysis in paragraph H and sub- 2 I ject to additional conditions imposed at the Planning Commission Public 2 Hearing as amended by the applicant. 3 (b) No certificate of occupancy for any structure within the PCD (Z- 6318 -C), shall be 4 issued until all infrastructure improvements contained within the record before the 5 Planning Commission, are completed in full and have been accepted by the City 6 of Little Rock, Arkansas. 7 Section 3. The preliminary site development plan/plat be approved as recommended 8 by the Little Rock Planning Commission. 9 Section 4. The change in zoning classification contemplated for Dairy Land Revised 10 Long -form PCD (Z- 6318 -C), located on the Southwest corner of Chenal Parkway and 11 Kanis Road is conditioned upon obtaining a final plan approval within the time specified 12 by Chapter 36, Article VII, Section 36 -454 (e) of the Code of Ordinances. 13 Section 5. The map referred to in Chapter 36 of the Code of Ordinances of the City of 14 Little Rock, Arkansas, and designated district map be and is hereby amended to the ex- 15 tent and in the respects necessary to affect and designate the change provided for in Sec - 16 tion 1 hereof. 17 Section 6. This Ordinance shall not take effect and be in full force until the final ap- 18 proval of the plan, and no structure shall be granted a certificate of occupancy until all 19 infrastructure improvements have been completed and accepted by the City of Little rock, 20 Arkansas. 21 Section 7. Severability. In the event any title, section, paragraph, item, sentence, 22 clause, phrase, or word of this ordinance is declared or adjudged to be invalid or uncon- 23 stitutional, such declaration or adjudication shall not affect the remaining portions of the 24 ordinance which shall remain in full force and effect as if the portion so declared or ad- 25 judged invalid or unconstitutional was not originally a part of the ordinance. 26 Section 8. Repealer.
