3 AN ORDINANCE TO ESTABLISH AND LAY OFF CITY OF LITTLE ROCK MUNICIPAL
4 PROPERTY OWNERS' MULTIPURPOSE IMPROVEMENT DISTRICT NO. 709 -08; AND
5 FOR OTHER PURPOSES.

7 WHEREAS, a Petition to form City of Little Rock Municipal Property Owners' Multipurpose Improvement
8 District No. 709 -08 has been filed with the Little Rock City Clerk; and
9 WHEREAS, the City Clerk has presented the petition to the Mayor; and
10 WHEREAS, the Mayor has set August 5, 2008, at 6:00 p.m. as the date and time for a hearing before the
11 Little Rock Board of Directors for consideration of the petition; and
12 WHEREAS, the Little Rock Board of Directors has determined from an abstractor's certificate of
13 property ownership that those signing the petition constitute all the owners of the real property to be
14 located in said district; and
15 WHEREAS, the Arkansas Municipal Property Owners' Improvement District Law provides that if the
16 governing body determines that all the owners of the real property to be located in the district have
17 petitioned for the improvements, it shall then be its duty by ordinance to establish and lay off the district
18 as defined in the petition and to appoint the commissioners named in the petition.
19 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK,
20 ARKANSAS:
21 Section 1. That the real property described in Exhibit "A" attached hereto and made a part hereof is
22 hereby established and laid off as City of Little Rock Municipal Property Owners' Multipurpose Improvement
23 District No. 709 -08 for the purpose of constructing, either within or without the boundaries of the District,
24 if the property within the District will be benefited thereby, a sewage collection system, water distribution
25 system, telephone service system, cable television service system, electrical distribution system, natural
26 gas distribution system, a system of roads and streets, including sidewalks, curbs and gutters, underground
27 drainage system, a system of street lighting, retaining walls, and landscaping, and all trenching,
28 excavating, grading and all construction associated with the installation of the above systems, together
29 with facilities related to any of the foregoing within said district.
30 Section 2. The following three individuals are hereby appointed as commissioners of said improvement
31 district: Russell R. Huckaby, Lori Huckaby and Bobby Francis.

Section 3. The name of improvement district shall be City of Little Rock Municipal Property Owners'
Multipurpose Improvement District No. 709 -08.
Section 4. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or
adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and
effect as if the portion so declared or adjudged to be invalid or unconstitutional was not originally a part of
the ordinance.
Section 5. Repealer. All laws, ordinances, resolutions, or parts of the same that are
inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
Section 6. The Board of Directors hereby determines that there is a need for additional infrastructure
within the City and hereby determines that the passage of this ordinance will facilitate construction of
additional infrastructure within the City. Therefore, an emergency is hereby declared to exist, and this
ordinance being necessary for the public health, safety and welfare shall be in full force and effect from
and after its passage and approval.
