19990ORDINANCE NO. 19,990 AN ORDINANCE APPROVING A PLANNED ZONING DEVELOPMENT AND ESTABLISHING A PLANNED COMMERCIAL DISTRICT TITLED PARK AVENUE LONG -FORM PCD (Z- 4953 -B), LOCATED ON THE NORTHWEST CORNER OF ST. VINCENT CIRCLE AND UNIVERSITY AVENUE, LITTLE ROCK, ARKANSAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY OF LITTLE ROCK; AND FOR OTHER PURPOSES. BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS. SECTION 1. That the zoning classification of the following described property be changed from C -3, General Commercial District to PCD: All of the Amended Replat of Developers Subdivision of Part of the Southeast 1/4 of the Northeast' /4 of Section 1, Township 1 North, Range 13 West, Little Rock, Pulaski County, Arkansas, as per the plat recorded in Pat Book 20 at Page 22 Records of Pulaski County, Arkansas and Tract B, Baird's Replat of Patton, Cella, Baird Subdivision of the Southeast '/4 of the Northeast 1/4 of Section 1, Township 1, Range 13 West, Little Rock Pulaski County, Arkansas as per the plat recorded in Plat Book 20 at Page 9, records of Pulaski County, Arkansas. SECTION 2. That the approval of Park Avenue Long -form PCD (Z- 4953 -B), located on the Northwest corner of St. Vincent Circle and University Avenue is subject to compliance with the following additional conditions: • That the preliminary site development plan/plat be approved as submitted, including all staff comments and conditions as outlined in the Planning Commission Agenda Staff Report in paragraphs D, E, F and including any conditions indicated in the staff analysis in paragraph H and subject to additional conditions imposed at the Planning Commission Public Hearing as amended by the applicant. • The approved uses for the development shall include the uses identified in the C -3, General Commercial Zoning District uses and multi - family as per the approved plan. • Season and temporary sales, outside, shall be permitted a maximum of four occasions per year with a maximum of thirty days per event. Outdoor display of merchandise is allowed in an area equal to one -half of the facade area of the front of the building. • Eating places shall be permitted to have an outdoor seating area subject to compliance with the following: The area of outdoor dining shall not be located in the public right of way nor shall it obstruct pedestrian movement, fire lanes, access to any business or areas designated for access by the physically impaired. The number of seats shall not exceed fifty percent of the number of seats within the eating place. • A maximum of 40,000 square feet of restaurant space is allowed within the development. • Building signage is intended to allow window, blade, awning and building signage for the retail and theatre uses. Sign totals will equal 10% of the height multiplied by the width of the fagade area to be "signed ". For freestanding buildings, building signage would be allowed on three sides, except the second or third sign area total would be reduced by half, as an example: A. Primary Entrance Elevation: Assuming 190' wide and 30' tall x 10% would allow 570 total square feet for all building, blade window and/or awning signs on the front elevation. B. Rear Elevation: Assuming 190' wide and 30' tall x 5% would allow 285 total square feet for all building, blade window and/or awning signs on the rear elevation. C. Side Elevation: Assuming 160' wide and 30' tall x 5% would allow 240 total square feet for all building, blade window and/or awning signs on the side elevation. • Buildings with a second entrance "end -cap" or two faced storefronts would be allowed a second sign as described in B or C above. • Directional or "way finding" signs will include tenant logos. • Seasonal banners shall be allowed on light poles within the development. • One temporary special event on- premise banner or device per premise per street frontage as allowed by the administrator for special events or grand openings is allowed. For these events these signs may be erected for a maximum of six weeks per occasion, not to exceed four events in a calendar year. Additional criteria shall be as established in Section 36- 557(d) of the Little Rock Municipal Code of Ordinances. No temporary special event banner or device shall be allowed within the public right of way. • The building fagades will utilize a predominance of masonry, stone, or exterior insulation finish system and the retail ground floor will utilize a glass store front system. To address long or tall building elevations, special care shall be taken to break up the mass with articulations of color and/or material change. 2 SECTION 3. That the preliminary site development plan/plat be approved as recommended by the Little Rock Planning Commission. SECTION 4. That the change in zoning classification contemplated for Park Avenue Long -form PCD (Z- 4953 -B), located on the Northwest corner of St. Vincent Circle and University Avenue is conditioned upon obtaining a final plan approval within the time specified by Chapter 36, Article VII, Section 36 -454 (e) of the Code of Ordinances. SECTION 5. That the map referred to in Chapter 36 of the Code of Ordinances of the City of Little Rock, Arkansas, and designated district map be and is hereby amended to the extent and in the respects necessary to affect and designate the change provided for in Section 1 hereof. SECTION 6. That this Ordinance shall not take effect and be in full force until the final approval of the plan. SECTION 7. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the ordinance. SECTION 8. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
