19983I ro ORDINANCE NO. 19,983 3 AN ORDINANCE TO CONTINUE A TOTAL SURCHARGE PER GROUND TRANS- 4 PORTATION TRIP PURSUANT TO THE LITTLE ROCK TRANSPORTATION CODE, s LITTLE ROCK, ARK., REV. CODE § 34 -43 (B)(5)C. (1988), DUE TO A DRA- G MATIC INCREASE IN THE PRICE OF GASOLINE; TO DECLARE AN EMERGENCY; 7 AND FOR OTHER PURPOSES. 8 9 WHEREAS, the Board of Directors of the City of Little Rock, Arkansas, has adopted a 10 comprehensive Transportation Code which governs the operation of vehicles for hire >> within the corporate limits of the City, and 12 WHEREAS, Section 34 -43 of the Code sets out in detail the rates and additional 13 charges that can be charged to passengers of properly licensed vehicles for hire, and 14 WHEREAS, the Board of Directors notes that since January 1, 2008, gasoline prices 15 have risen approximately 18 %, and the price of a gallon of gasoline in many parts of 16 the City has exceeded three dollars and fifty cents a gallon ($3.50 /gallon), and 17 WHEREAS, Greater Little Rock Transportation Services states that, on the average, the 18 drivers are spending between $10.00 and $13.00 more daily just for fuel, not to men- 19 tion their other expenses, and 20 WHEREAS, it is essential to the well -being of the City that there be appropriate vehi- 21 cles for hire to assist with the transportation of persons who do not, or cannot, use 22 other public or private transportation, but the high cost of gasoline is threatening the 23 ability of transportation providers to operate, and 24 [PAGE 1 OF 31 Ordinance to Continue a Total Surcharge Per Ground Transportation Trip Pursuant to the Little Rock Transportation Code I WHEREAS, on September 20, 2005, the Board of Directors adopted a fuel surcharge 2 provision to the Little Rock Transportation Code which provides that a total surcharge 3 per trip, as set by the Board of Directors, may be charged to each load if the Board is 4 asked to do so, and it is determined that an increase in the price of fuel during the s time period of January 1 of any given year to the date of that same year when the sur- 6 charge is approved justifies such change, and 7 WHEREAS, Greater Little Rock Transportation Services has requested a total surcharge 8 per trip, and 9 WHEREAS, on May 6, 2008, the Board of Directors adopted a total fuel surcharge per 10 trip of $1.00 pursuant to Little Rock, Ark., Rev. Code § 34- 43(b)(5)c. I i WHEREAS, due to the dramatic and continued increase in the price of gasoline since 12 January 1, 2008, the Board of Directors feels it is necessary to continue this total sur- 1 3 charge per trip of $1 .00 pursuant to Little Rock, Ark., Rev. Code § 34- 43(b)(5)c. 14 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF is LITTLE ROCK, ARKANSAS: 16 Section 1. Due to the dramatic and continued increase in the price of gasoline since 17 January 1, 2008, the Board of Directors hereby continues in effect a total surcharge per 18 trip of $1.00 pursuant to Little Rock, Ark., Rev. Code § 34- 43(b)(5)c. 19 Section 2. Severability. The provisions of this Ordinance are hereby declared to be 20 severable. If any provision shall be held to be invalid or to be inapplicable to any per - 21 sons or circumstances, such invalidity or inapplicability shall not affect the remainder 22 of the provisions of this Ordinance. 23 Section 3. Repealer. All laws and parts of laws are hereby repealed to the extent of 24 such inconsistency with this ordinance. Emergency Clause. The Board of Directors has determined that it is crucial to the public health, safety, and welfare, that there be in place meaningful transporta- tion service from vehicles for hire that are available to citizens and visitors to the City; further, that increases in the cost of fuel can be so dramatic as to threaten the ability of operators and drivers to provide this service; further, that since January 1, 2008, the cost of gasoline has dramatically increased, which would make the application of a surcharge per trip for fuel expense appropriate; an emergency is, therefore, declared to exist and this ordinance shall be in full force and effect from and after the date of its passage.
