19961ORDINANCE NO. 19,961 AN ORDINANCE APPROVING A MODIFICATION TO A PLANNED ZONING DEVELOPMENT AND ESTABLISHING A PLANNED COMMERCIAL DISTRICT TITLED LUSK MINI - STORAGE REVISED LONG -FORM PCD (Z- 7436 -B), LOCATED AT 14300 CANTRELL ROAD, LITTLE ROCK, ARKANSAS, AMENDING ORDINANCE NO. 18921 AND THE OFFICIAL ZONING MAP OF THE CITY OF LITTLE ROCK; AND FOR OTHER PURPOSES. BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS. SECTION 1. That Ordinance No. 18921 adopted by the Little Rock Board of Directors on August 19, 2001, be amended to provide for modification of the Planned Zoning District described as Lusk Long -form PCD (Z- 7436); SECTION 2. That the zoning classification of the following described property be changed from PCD to Revised PCD: Part of the SE '/4 SE '/4 of Section 18, T -2 -N, R -13 -W, Little Rock, Pulaski County, Arkansas lying north of Arkansas State Highway 10 more particularly described as follows: Beginning at the Northeast corner of the SW '/4 SE '/4 of said Section 18; thence S88 °43'28 "E, 330.0 feet; thence S01 031'09 "W, 453.08 feet; thence S01 022'03 "W, 531.63 feet; thence N88 048'39 "W, 325.27 feet to a point on the east line of said SW '/4 SE '/4, Section 18; thence NO1 °09'44" along said east line, 985.21 feet to the point of beginning, containing 322,388 square feet or 7.4010 acre more or less. SECTION 3. That the approval of Lusk Mini - storage Revised Long -form PCD (Z- 7436 -B), located at 14300 Cantrell Road is subject to compliance with the following additional conditions: • That the preliminary site development plan/plat be approved as submitted, including all staff comments and conditions as outlined in the Planning Commission Agenda Staff Report in paragraphs D, E, F and including any conditions indicated in the staff analysis in paragraph H and subject to additional conditions imposed at the Planning Commission Public Hearing as amended by the applicant. SECTION 4. That the preliminary site development plan/plat be approved as recommended by the Little Rock Planning Commission. SECTION 5. That the change in zoning classification contemplated for Lusk Mini - storage Revised Long -form PCD (Z- 7436 -B), located at 14300 Cantrell Road is conditioned upon obtaining a final plan approval within the time specified by Chapter 36, Article VII, Section 36 -454 (e) of the Code of Ordinances. SECTION 6. That the map referred to in Chapter 36 of the Code of Ordinances of the City of Little Rock, Arkansas, and designated district map be and is hereby amended to the extent and in the respects necessary to affect and designate the change provided for in Section 1 hereof. SECTION 7. That this Ordinance shall not take effect and be in full force until the final approval of the plan. SECTION 8. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the ordinance. SECTION 9. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
