PULASKI COUNTY CIRCUIT /COUNTY CLERK ORDINANCE NO. 19954 Fees $0.00 AN ORDINANCE TO REPEAL S 5 -76 (c) OF THE CODE OF ORDINANCES PERTAINING TO EMERGENCY RECEIVING FACILITY DIVERSIONS; DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES. WHEREAS, patients who have been recently discharged from a given hospital who then have an acute medical condition requiring an ambulance trip back to the hospital can often not get back to the facility where their medical records are maintained due to that hospital's emergency receiving facility being on diversion; and WHEREAS, patients who are informed that their hospital is on diversion have refused ambulance transport and driven themselves to the hospital, sometimes at great risk to themselves; and WHEREAS, diversion has become so common that in practice it no longer works and the City ordinance authorizing same should be repealed to permit a new policy to be implemented. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: Section 1. Little Rock, Ark., Rev. Code S 5 -76 (c) is hereby repealed and subsequent paragraphs renumbered. Section 2. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of this ordinance, which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of this ordinance. Section 3. Emergency Clause. Whereas, it has been determined that the emergency receiving facility diversion policy in the ordinance no longer operates effectively due to changed conditions; and whereas, the Board of Directors has determined it should be repealed to permit a new policy to be implemented; and further that such repeal will not adversely affect the health and welfare of the citizens of Little Rock, an emergency is hereby declared and this Ordinance shall take effect immediately upon its passage.
