3 AN ORDINANCE TO AMEND CHAPTER 30 OF THE CODE OF ORDINANCES OF
4 THE CITY OF LITTLE ROCK, ARKANSAS, TO PROVIDE FOR A VARIANCE FOR
5 DEDICATION OF RIGHT -OF -WAY AS REQUIRED BY THE MASTER STREET PLAN
6 FOR N. UNIVERSITY AVE.; AND FOR OTHER PURPOSES.

8 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE
9 ROCK, ARKANSAS:
10 Section 1. Chapter 30 of the Code of Ordinances is hereby amended to provide for a reduction of
11 certain requirements within the Master Street Plan on N. University Ave. until the property is
12 redeveloped for LPS Properties, LLC. as part of the Storthz Short -form POD located at 424 N. University
13 Ave.
14 Subsection a. Chapter 30 Article VI requiring property owners to dedicate right -of -way to the
15 requirements of the Master Street Plan be reduced at 424 N. University Ave. as part of the
16 Storthz Short -form POD. The specific reduction in the right -of -way dedication at 424 N.
17 University Ave. is to 45 ft from centerline from 55 ft from centerline on principal arterial
18 streets.

20 Subsection b. On N. University Ave., a 45 foot right of way dedication from centerline along
21 the frontage of the property on N. University Ave. will be required. On Father Tribou Street, a
22 30 foot right of way dedication from centerline along the frontage of the property on Father
23 Tribou Street will be required.

25 Subsection c. If the property at 424 N. University Ave. is redeveloped in the future, the owner
26 will be required to dedicate full right -of -way to the Master Street Plan standards and any other
27 requirements as found in Chapter 30 Article VI along the frontage of the property.
28 Section 2. Severability. In the event any title, section, paragraph, item, sentence, clause,
29 phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such
30 declaration or adjudication shall not affect the remaining portions of this ordinance, which shall
31 remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional was
32 not originally a part of this ordinance.
33 Section 3. Repealer. All ordinances or resolutions of the City in conflict herewith are hereby
34 repealed to the extent of such conflict.
