19768I ORDINANCE NO. 191768 2 3 AN ORDINANCE TO ABANDON THE NORTH 15 FEET OF THE FIRST TEE WAY 4 EXCESS RIGHT -OF -WAY (15 FEET BY APPROXIMATELY 200 FEET, TAPERING 5 TO 0 FEET TO THE EAST AND WEST) LOCATED ADJACENT TO 4520 S. 6 UNIVERSITY AVENUE AS PUBLIC RIGHT -OF -WAY; AND FOR OTHER 7 PURPOSES. E 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 WHEREAS, a request was made to vacate and abandon the North 15 feet of the First Tee Way excess right -of -way (15 feet by approximately 200 feet, tapering to 0 feet to the East and West), located adjacent to 4520 S. University Avenue as public right -of -way, pursuant to the City's general police power authority under Ark. Code Ann. S 14 -54 -104; and WHEREAS, the Board has determined that the abandoning of this public right -of -way will not have an adverse impact on the adjacent property owners nor the local traffic, and therefore, the right - of -way abandoned by this ordinance is no longer needed for corporate purposes, except as otherwise noted below; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: Section 1. The Board of Directors hereby releases, vacates, and abandons the North 15 feet of the First Tee Way excess right -of -way (15 feet by approximately 200 feet, tapering to 0 feet to the East and West), located adjacent to 4520 S. University Avenue, in the City of Little Rock. Section 2. The Little Rock Fire Department has required that access to fire hydrants must be maintained. Section 3. A copy of this ordinance, duly certified by the City Clerk, shall be filed in the real estate records of the recorder of the Circuit Clerk in ex officio recorder of Pulaski County, Arkansas. Section 4. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and effect as if the portion so declared or adjudged to be invalid or unconstitutional was not originally a part of the ordinance. Section 5. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
