2 AN ORDINANCE TO DISPENSE WITH THE REQUIREMENT OF
3 COMPETITIVE BIDDING AND AUTHORIZE THE CITY MANAGER TO
4 EXECUTE LAWSON SOFTWARE CONTRACT CHANGE ORDER NO. 6
s FOR ADDITIONAL TECHNOLOGY AND APPLICATION CONSULTING
6 SERVICES; AND FOR OTHER PURPOSES.
7 WHEREAS, by publication of Request for Proposals No. 5329, the City of Little Rock
s solicited proposals from qualified firms to provide a fully integrated, web - enabled
9 applications information system for the City's Enterprise Resource Planning System,
lo and
11 WHEREAS, Lawson Software, Inc. was selected by the City as the most qualified to
12 provide the products and services to implement an integrated suite of enterprise
13 applications that will meet the City's present and future needs, and
14 WHEREAS, on February 7, 2006, the Little Rock Board of Directors, by passage of
is Resolution No. 12,202, authorized the City Manager to enter into an agreement with
16 Lawson Software, Inc. for the purchase and implementation of Lawson enterprise
17 software, and
18 WHEREAS, nine negotiated changes in products and services authorized by the Little
19 Rock Board of Directors resulted in a 20.2% increase over Lawson Software Inc.'s
20 original cost proposal, and
21 WHEREAS, additional application and technical consulting services are needed to
22 complete the Lawson software implementation process, but the cost of such services
23 will result in a total contract amount that exceeds 25% above the original bid proposal
24 and would be paid without a separate competitive bidding process, and

I WHEREAS, it is impractical and unfeasible to have a company other than Lawson
2 Software, Inc. provide the consultation services that are requisite to the Lawson
3 Software implementation methodology, and
4 WHEREAS, competitive bidding should be waived and a Change Order executed with
5 Lawson Software, Inc. as the sole source provider of the application and technical
6 consultation services that are required to complete the City's Enterprise Resource
7 Planning software implementation process.
8 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF
9 LITTLE ROCK, ARKANSAS:
10 Section 1. The Board of Directors finds that competitive bidding should be
11 dispensed with in the purchase of additional Lawson Software implementation
12 consultation services, as an exceptional situation exists and competitive bidding is
13 impractical and infeasible.
14 Section 2. The City Manager is hereby authorized to enter into Change Order No.
15 6 with Lawson Software, Inc. for the purchase of 647 hours of Phase 1 application and
16 technical consulting, 844 hours of Phase 2 application consulting, and 64 hours of
17 project management, in the amount of Two Hundred Fifty Six Thousand, Eight Hundred
18 Fifty Four Dollars ($256,854.00) and an amount not to exceed Forty One Thousand,
19 Ninety Six Dollars and Sixty Four Cents ($41,096.64) for reimbursement of travel -
20 related expenses for the additional on -site services, as provided in Section 1.3 of the
21 Lawson Fee Service Order Form.
22 Section 3. Funds for this purchase are available from the 2006 short -term
23 financing.
24 Section 4. Severabi/ity. In the event any title, section, paragraph, item, sentence,
25 clause, phrase, or word of this ordinance is declared or adjudged to be invalid or

I unconstitutional, such declaration or adjudication shall not affect the remaining
2 portions of the ordinance which shall remain in full force and effect as if the portion so
3 declared or adjudged invalid or unconstitutional was not originally a part of the
4 ordinance.
5 Section 5. Repealer. All ordinances and resolutions, and parts thereof, which are
6 in conflict with any provision of this ordinance are hereby repealed to the extent of
7 such conflict.
