3 AN ORDINANCE TO AMEND A PORTION OF ARTICLE I OF CHAPTER 6
4 "ANIMALS" OF THE LITTLE ROCK CODE OF ORDINANCES TITLED "GENERAL
5 PROVISIONS" TO PROVIDE A CLARIFICATION OF TRAPPING OF NUISANCE
6 ANIMALS IN THE CITY OF LITTLE ROCK; AND FOR OTHER PURPOSES.

8 WHEREAS, Article I of Chapter 6 of the Little Rock Code of Ordinances (commonly referred to as
9 the "Animal Ordinance ") is inconsistent with Arkansas Game and Fish Commission (AGFC) Regulations in
10 that it allows only live trapping of nuisance animals except during the AGFC established fur bearing
11 season; and
12 WHEREAS, the City has a responsibility to the citizens to provide for a safe environment by the use
13 of effective control options while continuing to coexist with these nuisance animals; and
14 WHEREAS, the Animal Services Advisory Board approved the amendment at their May 16, 2007
15 meeting;
16 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE
17 ROCK, ARKANSAS:
18 Section 1. Chapter 6 Animals, Article I, Section 6 - 6 (b) Trapping of the Little Rock Code of
19 Ordinances is amended to read as follows:
20 (b) Exceptions.
21 (1) Subsection (a) shalt not apply to the indoor trapping of rats and mice.
22 (2) Subsection (a) shall not apply to fur bearing season traps authorized by the Arkansas
23 Game and Fish Commission pursuant to the Game and Fish Commission Code of
24 Regulations.
25 (3) Trapping of rabbits and other nuisance animals in humane box traps is permitted for
26 relocation of the animal in accordance with the Arkansas Game and Fish Commission
27 Code of Regulations.
28 (4) Subsection (a) shall not apply to licensed, insured contractors doing business in the City
29 for the purpose of trapping of nuisance beaver, muskrat, nutria, groundhog, gophers,
30 moles, and skunks in accordance with the Arkansas Game and Fish Commission Code of
31 Regulations.
32 Section 2. Severability. In the event any title, section, paragraph, item, sentence, phrase or
33 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or
34 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force
35 and effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part
36 of the ordinance.

Section 3. Repealer. All laws, ordinances, resolutions, or parts of the same, that are
inconsistent with the provisions of this Ordinance, are hereby repealed to the extent of such
inconsistency.
