19744ORDINANCE NO. 19,744 AN ORDINANCE APPROVING A PLANNED ZONING DEVELOPMENT AND ESTABLISHING A PLANNED RESIDENTIAL DISTRICT TITLED PLACE PROPERTIES STUDENT HOUSING LONG -FORM PD -R (Z- 8169), LOCATED SOUTH OF ASHER AVENUE AND EAST OF UNIVERSITY AVENUE, LITTLE ROCK, ARKANSAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY OF LITTLE ROCK; AND FOR OTHER PURPOSES. BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS. SECTION 1. SECTION 2. That the approval of Place Properties Student Housing Long -form PD -R (Z- 8169), located South of Asher Avenue and East of University Avenue is subject to compliance with the following additional conditions: • That the preliminary site development plan/plat be approved as submitted, including all staff comments and conditions as outlined in the Planning Commission Agenda Staff Report in paragraphs D, E, F and includeing any conditions indicated in the staff analysis in paragraph H and subject to additional conditions imposed at the Planning Commission Public Hearing as amended by the applicant. • A signal for pedestrian access from the development to UALR will be constructed and completed prior to issuance of the final certificate of occupancy. • The applicant will construct the design of the street including left turn lanes, pedestrian crossings on both sides of the intersection and pedestrian refuge islands. • Access to the Village Shopping Center must be maintained from Asher Avenue. • The private access easement on the east side of the property will be constructed as a 36 -foot roadway from Asher Avenue to the main 2 gated entrance and may be constructed to a reduced standard from that point to serve the property to the south of the site. • The maximum building height shall be 40 -feet. • The perimeter fence shall be constructed of brick, wood or wrought iron or a combination of these materials. The maximum fence height shall be eight (8) feet. SECTION 3. That the preliminary site development plan/plat be approved as recommended by the Little Rock Planning Commission. SECTION 4. That the change in zoning classification contemplated for Place Properties Student Housing Long -form PD -R (Z- 8169), located South of Asher Avenue and East of University Avenue is conditioned upon obtaining a final plan approval within the time specified by Chapter 36, Article VII, Section 36 -454 (e) of the Code of Ordinances. SECTION 5. That the map referred to in Chapter 36 of the Code of Ordinances of the City of Little Rock, Arkansas, and designated district map be and is hereby amended to the extent and in the respects necessary to affect and designate the change provided for in Sections 1 and 2 hereof. SECTION 6. That this Ordinance shall not take effect and be in full force until the final approval of the plan. SECTION 7. &verability. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the ordinance. SECTION 8. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
