19733ORDINANCE NO. 19,733 AN ORDINANCE REPEALING ORDINANCE NO. 19,479 AND REVOKING A PLANNED ZONING DISTRICT TITLED BOWMAN KANIS RETAIL CENTER LONG -FORM PCD, LOCATED ON THE NORTHWEST CORNER OF KANIS AND BOWMAN ROADS (Z- 6554 -E) IN THE CITY OF LITTLE ROCK ARKANSAS; AND FOR OTHER PROPOSES. WHEREAS, Ordinance No. 19,479 was adopted on February 7, 2006, establishing a planned zoning district; and WHEREAS, the owner of the subject property has requested the repeal of the "PZD" ordinance and restoring of the zoning classification as previously existed. NOW, THEREFORE BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS. SECTION 1. That Ordinance No. 19,479 is hereby repealed, removing from the official zoning map the classification PCD titled Bowman Kanis Retail Center Long -form PCD, located on the Northwest corner of Kanis and Bowman Roads (Z- 6554 -E). SECTION 2. That the property described as: A part of the S '/z of the NW '/4 of Section 4, T -1 -N, R -13 -W, Little Rock, Pulaski County, Arkansas being part of Tracts 11, 12, 13, 14 and 15, Montclair Subdivision, Pulaski County, Arkansas more particularly described as: Beginning at the southeast corner of Tract 15, said Montclair Subdivision; thence N87 °37'58 "W along the south line of said Tracts 15, being also the north right -of- way line of Kanis Road, 250.02 feet to the southwest corner of said Tract 15; thence NO1 °47'33 "E along the west line of said Tract 15, 407.84 feet; to a point on the south line of Sam's Tract, Spencer Addition, Little Rock, Arkansas; thence along the south line of said Sam's Tract the following: (1) N47 °50'26 "E, 323.91 feet; (2) S87 °55'26 "E, 21.92 feet; (3) NO 1'49'36"E, 21.49 feet; (4) N47 °48'31 "E, 282.73 feet; (5) SO1 °59'35 "W, 19.57 feet and (6) S87 °55'12 "E, 380.13 feet to a point on the west right -of -way line of Bowman Road; thence SO1 °10'01 "W along said west right -of -way line 470.11 feet; thence SO1 °39'45 "W continuing along said west right -of -way line, 57.74 feet; thence N87 °17'59 "W, 289.89 feet; thence SO1 014'57 "W, 185.33 feet; thence S10 010'38 "E, 103.69 feet; thence S02042'OI "W, 24.11 feet to a point of the north right -of -way line of Kanis Road; thence N87 °45'01 "W along said north right -of -way line, 313.60 feet to the point of beginning, containing 515,990 square feet or 13.9 acres, more or less. be restored to R -2, 0-3 and C -3, as existed prior to the adoption of Ordinance No. 19,479 on February 7, 2006. SECTION 3. That the map referred to in Chapter 36 of the Code of Ordinances of the City of Little Rock, Arkansas, and designated district map be and is hereby amended to the extent and in the respects necessary to affect and designate the change provided for in Sections 1 and 2 hereof. SECTION 4. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the ordinance. SECTION 5. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency. SECTION 6. It is hereby determined by the Board of Directors of the City of Little Rock that there is immediate need to revoke the PD -R zoning classification for the Bowman Kanis Retail Center Long -form PCD, located on the Northwest corner of Kanis and Bowman Roads (Z- 6554-E). An emergency is therefore declared to exist and this ordinance shall be in full force and take effect from and after its passage and approval.
