19727ORDINANCE NO. 19,727 AN ORDINANCE REPEALING ORDINANCE NO. 17,094 AND REVOKING A PLANNED ZONING DISTRICT TITLED MCALMONT POD, LOCATED AT 1814 — 1824 MCALMONT STREET (Z -6062) IN THE CITY OF LITTLE ROCK ARKANSAS; AND FOR OTHER PROPOSES. WHEREAS, Ordinance No. 17,094 was adopted on January 16, 1996, establishing a planned zoning district; and WHEREAS; the POD use never developed; and WHEREAS, the Little Rock Planning Commission has determined the POD should be revoked per Section 36- 458(a) and the zoning classification as previously existed restored. NOW, THEREFORE BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS. SECTION 1. That Ordinance No. 17,094 is hereby repealed, removing from the official zoning map the classification POD titled McAlmont POD, located at 1814 — 1824 McAlmont Street (Z- 6062). SECTION 2. That the property described as: A parcel of land in Section 11, T -1 -N, R -12 -W, and located at 1814 -16, 1818 -20 and 1822 -24 McAlmont Street, Little Rock, Arkansas, being more particularly described as follows: Lot 5, Block B, Oak Glen Addition, Less and Except, Beginning at the Southeast corner of Lot 5, thence west 69.54 feet to the westerly right of way line of I -30; thence northeasterly and along said right of way 54.0 feet; thence south along the east line of Lot 5, 50.3 feet to the point of beginning. :►n. Lot 6, Block B, Oak Glen Addition, Less and Except, Beginning at the southeast corner of Lot 6, thence west 50.04 feet to the westerly right of way line of I -30; thence northeasterly and along said right of way line 54.0 feet; thence east along the north line of Lot 6, a distance of 31.3 feet; thence south along the east line of Lot 6, 50.0 feet to the point of beginning. AND Lot 7, Block B, Oak Glen Addition, Less and Except, Beginning at the southeast corner of Lot 7, thence west 31.3 feet to the westerly right of way line of I -30; thence northeasterly and along said right of way 54.0 feet; thence east along the north line of Lot 7, a distance of 12.2 feet; thence south along the east line of Lot 7, 50.3 feet to the point of beginning. Said described property containing 0.389 acres, more or less. be restored to R -4, as existed prior to the adoption of Ordinance No. 17,094 on January 16, 1996. SECTION 3. That the map referred to in Chapter 36 of the Code of Ordinances of the City of Little Rock, Arkansas, and designated district map be and is hereby amended to the extent and in the respects necessary to affect and designate the change provided for in Sections 1 and 2 hereof. SECTION 4 clause, phrase, or unconstitutional, such ordinance which shall remain in full Severability. In the event any title, word of this ordinance is declared declaration or adjudication shall not section, paragraph, item, sentence, or adjudged to be invalid or affect the remaining portions of the force and effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of the ordinance. SECTION 5. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency. SECTION 6. It is hereby determined by the Board of Directors of the City of Little Rock that there is immediate need to revoke the PD -R zoning classification for the McAlmont POD, located at 1814 —1824 McAlmont Street (Z- 6062). An emergency is therefore declared to exist and this ordinance shall be in full force and take effect from and after its passage and approval.
