3 AN ORDINANCE TO AMEND ORDINANCE NO. 19,676 TO CLARIFY OWNERSHIP
4 AFTER ABANDONMENT OF THE NORTH /SOUTH ALLEY RIGHT -OF -WAY (20
5 FEET BY 300 FEET) LOCATED WITHIN BLOCK 16, POPE'S ADDITION, IN THE
6 CITY OF LITTLE ROCK; AND FOR OTHER PURPOSES.
s WHEREAS, on January 2, 2007 the Board of Directors passed an ordinance to abandon the
9 north /south alley right -of -way (20 feet by 300 feet) located within Block 16, Pope's Addition, bounded
10 by East 3rd, East 4th, Rock and Commerce Streets, pursuant the City's general police power, and
11 WHEREAS, clarification as to ownership has been requested by underwriters for a project
12 proposed to include the abandoned right -of -way.
13 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE
14 ROCK, ARKANSAS THAT:
15 Section 1. The abandonment of the north /south 20 -foot wide alley right -of -way (20 feet by
16 300 feet) located within Block 16, Pope's Addition to the City of Little Rock, bounded by East 3rd, East
17 4th, Rock and Commerce Streets, except for the City's reservation of the public easements within the
18 former right -of -way, operates to extinguish any City ownership interest in the abandoned property,
19 which then reverts by operation of law to the owners of the abutting property, who will each own to
20 the centerline of the abandoned right -of -way next to their respective property.
21 Section 2. Severability. In the event any title, section, paragraph, item, sentence, clause,
22 phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such
23 declaration or adjudication shall not affect the remaining portions of the ordinance which shall remain
24 in full force and effect as if the portion so declared or adjudged invalid or unconstitutional were not
25 originally a part of the ordinance.
26 Section 3. Repealer. All ordinances or resolutions of the City in conflict herewith are hereby
27 repealed to the extent of such conflict.
