19718I ORDINANCE NO. 19,718 2 3 AN ORDINANCE TO ABANDON THE WEST 15 FEET OF THE POLK STREET 4 RIGHT -OF -WAY (15 FEET BY 140 FEET) LOCATED ADJACENT TO LOT 14, 5 BLOCK 8, NEWTON'S ADDITION TO THE CITY OF LITTLE ROCK; AND FOR 6 OTHER PURPOSES. fA 8 WHEREAS, a request was made to vacate and abandon the West 15 feet of the Polk Street 9 right -of -way (15 feet by 140 feet) located adjacent to Lot 14, Block 8, Newton's Addition to the City of 10 Little Rock, located at 5500 Country Club Blvd., pursuant to the City's general police power authority 11 under Ark. Code Ann. 5 14 -54 -104; and 12 WHEREAS, the Board has determined that the abandoning of this public right -of -way will not 13 have an adverse impact on the adjacent property owners nor the local traffic, and therefore, the right - 14 of -way abandoned by this ordinance is no longer needed for corporate purposes, except as otherwise 15 noted below; 16 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE 17 ROCK, ARKANSAS: 18 Section 1. The Board of Directors hereby releases, vacates, and abandons the West 15 feet of 19 the Polk Street right -of -way (15 feet by 140 feet) located adjacent to Lot 14, Block 8, Newton's 20 Addition to the City of Little Rock, located at 5500 Country Club Blvd. 21 Section 2. The City specifically reserves the public utility easements within the former right- 22 of -way. 23 Section 3. A copy of this ordinance duly certified by the City Clerk, shall be filed in the real 24 estate records of the recorder of the Circuit Clerk in ex officio recorder of Pulaski County, Arkansas. 25 Section 4. Severability. In the event any title, section, paragraph, item, sentence, clause, 26 phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such 27 declaration or adjudication shall not affect the remaining portions of the ordinance which shall remain 28 in full force and effect as if the portion so declared or adjudged to be invalid or unconstitutional was 29 not originally a part of the ordinance. 30 Section 5. Repealer.
