3 AN ORDINANCE TO ABANDON THE TEN (10) FOOT WIDE UTILITY EASEMENT
4 THAT EXTENDS ALONG THE EAST PERIMETER OF LOT 1, CORNELIA
5 THOMAS SUBDIVISION ( #2 LONGFELLOW LANE) IN THE CITY OF LITTLE
6 ROCK; AND FOR OTHER PURPOSES.

8 WHEREAS, a request was made to vacate and abandon the ten (10) foot wide utility easement
9 located along the East perimeter of Lot 1, Cornelia Thomas Subdivision, located at #2 Longfellow Lane,
10 pursuant to the City's general police power authority under Ark. Code Ann. S 14 -54 -104; and
11 WHEREAS, the Board has determined that the abandoning of this utility easement will not have
12 an adverse impact on the adjacent property owners nor the local traffic, and therefore, the easement
13 abandoned by this ordinance is no longer needed for corporate purposes, except as otherwise noted
14 below;
15 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE
16 ROCK, ARKANSAS:
17 Section 1. The Board of Directors hereby releases, vacates, and abandons the ten (10) foot
18 wide utility easement which extends along the East perimeter of Lot 1, Cornelia Thomas Subdivision,
19 located at #2 Longfellow Lane.
20 Section 2. A copy of this ordinance duly certified by the City Clerk, shall be filed in the real
21 estate records of the recorder of the Circuit Clerk in ex officio recorder of Pulaski County, Arkansas.
22 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause,
23 phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such
24 declaration or adjudication shall not affect the remaining portions of the ordinance which shall remain
25 in full force and effect as if the portion so declared or adjudged to be invalid or unconstitutional was
26 not originally a part of the ordinance.
27 Section 4. Repealer. All laws, ordinances, resolutions, or parts of the same that are
28 inconsistent with the provisions of this ordinance are hereby repealed to the extent of such
29 inconsistency.
