3 AN ORDINANCE TO ABANDON A 15- FOOT -WIDE UTILITY EASEMENT
4 LOCATED IN LOTS 3, 4, 5, AND 6, BLOCK 8, PFEIFER ADDITION,
5 LOCATED AT 5000 WEST MARKHAM STREET, LITTLE ROCK, ARKANSAS;
6 AND FOR OTHER PURPOSES.

8 WHEREAS, a request was made to abandon al 5-foot-wide utility easement
9 retained in the former right -of -way of an alley, which was abandoned by 0- 13,147
10 (April, 1976), pursuant to the City's general police power authority under Ark. Code
11 Ann. § 14 -54 -104;
12 WHEREAS, the Board has determined that the abandoning of this utility
13 easement will not have an adverse impact on the adjacent property owners nor the
14 local traffic, and therefore, the utility easement abandoned by this ordinance is no
15 longer needed for corporate purposes.
16 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
17 OF LITTLE ROCK, ARKANSAS:
18 Section 1 . The Board of Directors hereby releases, vacates, and abandons a 1 5-
19 foot -wide utility easement retained in the former right -of -way of an alley located in
20 Lots 3, 4, 5, and 6, Block 8, Pfeifer, located at 5000 West Markham, Little Rock,
21 Arkansas.
22 Section 2. A copy of this ordinance duly certified by the City Clerk, shall be
23 filed in the real estate records of the recorder of the Circuit Clerk in ex officio recorder
24 of Pulaski County, Arkansas.
25 Section 3. Severabi/ity. In the event any title, section, paragraph, item,
26 sentence, clause, phrase, or word of this ordinance is declared or adjudged to be

I invalid or unconstitutional, such declaration or adjudication shall not affect the
2 remaining portions of the ordinance which shall remain in full force and effect as if the
3 portion so declared or adjudged to be invalid or unconstitutional was not originally a
4 part of the ordinance.
5 Section 4. Repealer. All laws, ordinances, resolutions, or parts of the same
6 that are inconsistent with the provisions of this ordinance are hereby repealed to the
7 extent of such inconsistency.
