An Ordinance closing the alley in Block 19, Hillerest
Addition to the City of little Rock, Arkansas.
'lhereas, all the property owners in 3lock 19, ?iillcrest
Addition �o Little Rock, Arkansas, have petitioned the council
to close the alley in said block, abandon all the rights and title
of the city of little Rock and the youblic in and to the lands
embraced therein, -particularly the right to an easement over
said lands for Dublic use as an alley, and return same to the
adjacent land owners free from all the right, title and interest
of the City of Little Rock, Arkansas, or the public in and to same
as an alley,
And it appearing to the council that said alley has never been
opened or used by the public; that it will serve no useful Durpose
to retain said alley and that it will result in a benefit to the
adjacent land owners who own the fee in said lands to close and
abandon said alley,
And it further appearing that this council has by resolution
duly adopted directed the city clerk to give notice by a rublication
once a weel: for two weeks in some newspaper published in Pulaski
County, Arkansas, advising the property owners affected that on a
day therein named the council would hear the petition and determine
whether such property should be abandoned as an alley and whether
all abutting property owners and other persons directly interested
had consented to such abandonment; and it further appearing that
the said city clerk gave such notice as directed and as required
by law; and it further appearing that all persons owning property
abutting said alley have signed the petition to close same and that
no persons appeared at said hearing before this council and protested,
against the petition to close said alley,
Therefore, it is now ordained by the City Council of Little
Rocl >, Arkansas:

Section 1. That the alley in Block 19, Hillcrest Addition to
Little Rock, Arkansas, being a strip of land fifteen feet wide,
running from Holly Street northeast to the south side of Lot Four
and thence'northwest along the south side of lot Four to Kenyon
Street be and the same is hereby closed and abandoned as an alley
and all of the right, title and interest of the city of Little Rock,
Arkansas, and the public in general, particularly the eas-:ment of
said city therein for public use an as alley, in and to said lands
embraced in said alley as platted are hereby terminated and returned
to the adjacent property owners as their interests may appear in
fee simple , and this ordinance shall have the force and effect of
a judgment at law and shall vest the title to the lands embraced
in said alley in the adjacent land owners in fee simple, free
from the former easement of said city of little Rock therein for
public use as an alley.
Section 2. All ordinances or parts of ordinances in conflict
herewith are hereby repealed and this ordinance shall take effect
and be in force from and after its passage.
