ORDIZiAVICE TO REGULATE TiM TRAFFIC ON THE STREETS
f. AND ALLEYS OF THE CITY OF LITTLE ROCK IN CONFORMITY
WITH ACTS 185 AND 223 OF THE GENERAL ASSEEP'BLY OF 1927
OF TIM STATE OF ARKANSAS, AND FOR OTHER PURPOSES.

Section 1. Motor out -outs. The sale or use of cut -outs on any
7o motor driven vehicle while on the streets or alleys of the City of
Little Rock is hereby prohibited.
Section 2. Penalty for Section 1. Any person found guilty in
Little Rock Municipal Court of violating Section 1 of this ordinance
in whole or in part shall be deemed guilty of a misdemeanor and sub-
ject to a fine of not less than $10.00 and court costs or more than
$500.00 and court costs.
Section 3. Drivers_ Under the Influence of Intoxicating Liquor or
Narcotic Drums
It shall be unlawful for any person whether licensed
.r not who is an habitual user of narcotic drugs or any person who is
under the influence of intoxicating liquor or narcotic drugs to drive
any vehicle upon the streets or alleys of the City of Little Rook.
Section 4. Penalty for Section 3. Every person who is convd.cted
of violating Section 3 of this ordinance relating to habitual users
of narcotic drugs and driving vehicles while under the influence of
intoxicating liquors or narcotic drugs, shall upon conviction in
Municipal Court be punished by imprisonment in the Municipal jail for
not less than thirty days nor more than one year, or by a fine of not
less than $100,00 and court costs nor more than $1,000.00 and court
costs, or by both such fine and imprisonment. On a second or subse-
quent conviction he shall be punished by imprisonment for not less
than ninety days nor more than one year and, in the discretion of the
court, a fine of not more than one thousand ($1,000.00) dollars.
Section 5. Reckless Driving. Any person who drives any vehicle`
upon a street-or alley In the Cityv f Little Rock carelessly and
heedlessly-in willful or wanton disregard of the rights or safety of

others, or without due caution and circumspection and at a speed or in
a manner so as to endanger or be likely to endanger any person or
property, shall be guilty of reckless driving.
Section 6. Penalty for Section 5. Every person convicted of

reckless driving in the Municipal Court under Section 5 of this

ordinance shall be punished by imprisonment in the Municipal jail
for a period of not less than five days nor more than ninety days
or by fine of not less than $25.00 and court costs or more than
$500.00 and court costs, or by both such fine and imprisonment, and
on a second or subsequent conviction shall be punished by imprison-
ment for not less than ten days or more than six months, or by a fine
of not less than $50.00 and court costs nor$ more than $1000.00 and
court costs, or by both such fine and imprisonment.
Section 7. Duty to Stop After Accident Resulting; i:i Irijury tO

Any Person. -A driver of any vehicle involved in an accia °nt result-
ing in +she injury or death of any person shall immediately OOP such

Section 8. Erenalty for - Section 7. Every person convicted in
Municipal Court for violating Section 7 of this ordinance relative to
duty to stop in the event of certain accidents shall be punished by
imprisonment in the Municipal jail for not less than 30 days nor more
than 30 days, or by fine of not less than $100.00 and court costs nor
more than $500.00 and court costs, or both such fine and imprisonment,
or may be bound over to the Grand Jury under Section 63 of Act 223 of
1927.
Z t Section 9. Speed Restrictions. Any person driving a vehicle on
a street or alley in Little Rock shall drive the same at a careful ad
prudent speed not greater than is reasonable and proper, having due
regard to the traffic, surface and width of the roadway, and any other
conditions then existing, and no person shall drive any vehicle upon
a street or alley in the City of Little Rook at such speed as to en-
danger the life, limb or property of any person. Any speed whicr_ is
unsafe is unlawful.
.y.� Section 10. S�e6d _t`tirade Crossings. Fifteen miles an hour
shall be the maximum speed when approaching within fifty feet of a
grade crossing of any steam or electric railway when the driver's
view is obstructed. A driver's view shall be deemed to be obstructed
when at any time during the last two hundred feet of his approach to
such crossing he does not have a clear and uninterrupted view of such
railway crossing and of any traffic on such railway for a distance of

four hundred feet in both directions from the crossing.
0. Section 11. Speed Passing School Houses. Fifteen miles an hour
shall be the maximum speed when passing a school during school recess,
or while children are going to or leaving school during the opening
or closing hours.
Section 12. Speed on Approaching Street Intersections, Fifteen
miles an hour shall be the maximum speed when approaching within fifty
feet and.in traversing an intersection of streets or alleys when the
dri-v-erts view is obstructed. A driverts view shall be deemed to be
obstructed when at any time during the last fifty feet of his approach
to such intersection he does not have a clear and uninterrupted view
of such intersection and of the traffic upon all of the streets or
alleys entering such intersection for a distance of two hundred feet
from such intersection.
1Y4 Section 13. Speed Traversing a Grade or Going Around a Curve.
Fifteen miles an hour shall be the speed in traversing or going
around curves or traversing a grade upon the street when the driver's
vier is obstructed within a distance of 200 feet along such street in
t%ie direction in which he is proceeding.

Section 15. Speed in Business District. Fifteen miles an hour
shall be the maxinium speed on all streets or alleys in a business dis-
trict in the City of Little Rock. A business district shall be the
territory contiguous to a street in Little Rock when fifty per cent
or more of the frontage thereon for the length of a city block or more
is occupied by buildings in use for business.
Section 16. Sp�eed�in Resident District. Twenty miles an hone
shall be the maximum speed in a resident district as defined hereunder
and in public parks in the City of Little Rock. A resident district
shall be the territory contiguous to a street or alley not comprising
• business district when the frontage on such street for a distance of
• city block or more is mainly occupied by dwellings or by dwellings

and buildings in use for business.
Section 17. Speed Under all Other Conditions. Thirty -five miles
an hour shall be the maximum speed under- all other con&14 ions.
-v6 Section 18, Exceeding Foregoing Limitations Unlawful, It shall
be unlawful for any person to exceed any of the foregoing limitations.
In every charge of violation of speed regulations the complaint and
the summons or r_otiae to appear shall state the speed at which the
defendant is alleged to have driven also the speed which would have
been lawful at the time and place of such alleged violation.
Section 19. Fhen Speed Limits Not A_ p_ plicable. The speed limita-
tions set forth in this ordinance shall not apply to vehicles when
operated with due regard for safety under the direction of the police
in ikee or apprehension of violators of the law or of persons charged
with or suspected of any such violation, nor to fire department or
fire patrol vehicles when traveling in response to a fire alarm, nor to
public or private ambulances when traveling in emergencies. This
exemption shall not however, protect the driver of any such vehicle from
the consequences of a reckless disregard of the safety of others.

crossing -and a clearly visible and positive signal gives warningnf an
i,,, '- :diate approach of a railway train or car, it shall be unlawful for
the driver of the vehicle to fail to come to a complete stop before
crossing such railroad crossing.
Section 21. Driving or. Right Side of Street. Upon all streets of
sufficient width the driver of a vehicle shall drive the same upon the
right half of the street and shall drive a slow moving vehicle as
closely as possible on the right edge of the curb of such street, unless
it is impracticable to travel on such side of the street, and except
when overtaking and passing other vehicles subject to limitations set
forth in Sections 24, 252 26, 27, 28 and 29 of this ordinance.
7 Section 22. Keep to Right in Crossing Street Intersections or
Street and Railroad Intersections. In crossing an intersection of
streets or the intersection of a street and railroad right- of -w.ay, the
driver of a vehicle shall at all times cause such vehicle to travel
on the right half of the street unless such right side is obstructed
or impassable.

Section 23. Meeting of Vehicles. Drivers of vehicles proceeding
in opposite directions shall pass each other to the right, each giving
to the other at least one -half of the main traveled portion of the road-
way as nearly as possible.
Section 24. Overtaking a Vehicle. The driver of any vehicle
overtaking another vehicle proceeding in the same direction shall pass
at a safe distance to the left thereof, and shall not again drive to
the right side of the street until sagely clear of such overtaken
vehicle.
Section 25. Overtaking of Vehicles Outside of Busine„ or aesidenoe
District'. The driver of an overtaking motor vehicle not within a busi-
ness or residence district as herein defined shall give audible warning
with his horn or other warning device before passing or attempting to
pass a vehicle proceeding in the same direction.
Section 26. Passing on Left Side of Street. The driver of a vehicle
shall not drive to the left side of the center line of a street in over-
taking and passing another vehicle proceeding in the same direction
unless such left side is clearly visible and is free of oncoming traffic
for a sufficient distance ahead to permit such overtaking and passing
to be made in safety.
Section 27. Passing a Vehicle on a Grade or Upon a Curve. The
driver of a vehicle shall not overtake and pass another vehicle pro-
ceeding in the same direction upon the crest of a grade or upon a curve
of a street where the driver's view along the street is obstructed
within a distance of 500 feet.
Section 28. Passing a Vehicle at a Street Intersection or at any
Steam or Electric Railway Grade Crossing. The driver of a vehicle shall
not overtake and pass any vehicle proceeding in the same direction at
any steam or electric railway grade croseing or at any intersection of
streets unless permitted to do so by a traffic or police officer.
Section 29. Overtaken Driver to Give Nay. The driver of a vehicle
upon a street about to be overtaken and passed by another vehicle
approaching from the rear shall give way to the right in favor of the
overtaking vehicle on suitable and audible signal being given by the
driver of the overtaking vehicle, and shall not increase the speed of

Section 30. Following Too Closely. The driver of a motor vehicle

shall not follow another vehicle more closely than is reasonable and
prudent, having due regard to the speed of such vehicle and the traffic
upon and condition of the street.
Section 31. Trucks Following Too Closely. The driver of any motor
truck when traveling upon a street outside of a business or residence
district shall not follow another motor truck within one hundred feet,
but this shall not be construed to prevent one motor truck overtakir4;
and passing another.
�y 1 Section 32. Turning at Intersections. The driver of a vehicle
intendzing to turn to the right at an intersection shall approach such
intersection in the lane for traffic nearest to the right -hand side of
the street, and in turning shall keep as closely as practicable to the
right -hand curb or edge of the street, and when intending to turn to
the left shall approach such intersection in the lane for traffic to the
right of and nearest to the center line of the street and in turning
shall pass beyond the center of the intersection, passing as closely
as practicable to the right thereof before turning such vehicle to the
left.
Section 33. S_i nals on Stopping, Starting and Turning. The driver
of any vehicle upon the street before starting, stopping or turning
from a direct line shall first see that such movement can be made in
safety and if any pedestrian may be affected by such movement shall give
a clearly audible signal by sounding the horn, and whenever the operation
of any other vehicle may be affected by such movement shall give a signal
as required in this section plainly visible to the driver of such other
vehicle of the intention to make such movement.
-L, Section 34. Signals, How Dade. The signal required in Section 33
shall be given either by means of the hand and arm in the manner herein
specified, or by an approved mechanical or electrical signal device,
except that when a vehicle is so constructed or loaded. as to prevent the
hand and arm signal from being visible both to the front and the rear,
the signal shall be given by a device of a type which has been approved
by the Police Department.

M.enever the signal is given by means of the hand and arm, the
driver shall indicate his intention to start, stop, or turn by extend-
ing the hand and arm horizontally from and beyond the left side of the
vehicle.
�1 Section 35. Right -of -way. When two vehicles approach or enter an
intersection at approximately the same time, the driver of the vehicle
on the left shall yield the right of gray to the vehicle on the right---
except-as otherwise provided in Sections 37, 38 and 39.
Section 36. Vehicle Turning in Intersection to Have Right -of -Ray.
The driver of a vehicle approaching but not having entered an inter-
section shall yield the right of way to a vehicle within such inter-
section and turning therein to the left across the line of travel of
such first mentionedvehicle, provided the driver of the vehicle turning
left has given a plainly visible signal of intention to turn as required
in Section 33.
Section 37. Pedestrian and Right -of -way. The driver of any vehicle
upon a street within a business or residence district shall yield the
right of way to a pedestrian crossing such highway within any clearly

marked crosswalk or any regular pedestrian crossing included in the

prolongation of the lateral boundary lines of the adjacent sidewalk at

the end of a block, except at intersections where the movement of traffic
is being reyalated by traffic officers or traffic direction devices.
N Every pedestrian crossing a street within a business or residence dis-
trict at any point other than a pedestrian crossing, cross -walk or

intersection shall yield the right of way to vehicles upon the street.

nor shall it protect the driver of any such vehicle from the conse-
quence of an arbitrary exercise of such right of way.
e v Section 40. Duty on Approach of Police and Fire 2epgrtment Vehicles.
Upon the approach of any police or fire department/ g v ng audible signal
by bell, siren or exhaust whistle, the driver of �every other vehicle
shall i=mmediately drive the sate to a position as near as possible end
parallel to the right hand edge or curb of the street, clear of any
intersection of streets, and shall stop and remain in such position un-
less otherwise directed by a police or traffic officer until the police
or fire department vehicle shall have passed.
Section 41. Following Fire Department Vehicles. It shall be unlaw-
ful for -the driver of any vehicle other than one on official business to
follow any fire apparatus traveling in response to a fire alarm closer
than five hundred feet or to drive into or park such vehicle within the
block where fire apparatus has stopped in answer to a fire alarm.
Section 42. Passing Street Cars. The driver of a vehicle shall not
overtake and pass upon the left any street car proceeding in the same
direction, whether actually in motion or temporarily at rest, when a
travela.'ale portion of the street exists to the right of such street car.
Section 43. Stopping Behind Street Car. The driver of a vehicle
overtaking any street car stopped or about to stop for the purpose of
receiving or discharging any passenger, shall bring such vehicle to a
full stop at least ten feet in the rear of such street car and remain
stationary until any such passenger has boarded such car or reached the
adjacent sidewalk, except where safety zones have been established, or
at an intersection where traffic is controlled by an officer or a traffic
stop - and -go signal, vehicles need not be brought to a full stop 'before
passing any such railway or street car, but may proceed past such car
at a speed not greater than is reasonable or proper and in no event great-
er than ten miles an hour and with due caution for the safety of the
pedestrians.
i.o Section 44. Parking Near Fire Hydrant, Private Driveway, or Street
Intersection. No person shall park a vehicle or permit it to stand,
whether attended or unattended, upon a street in front of a private
driveway #or within fifteen feet of, a fire hydrant, or the entrance to
a fire station nor within 25 feet from the intersection of curb lines,

or if none, then within fifteen feet of the intersection of property
lines at an intersection of streets.
Section 45. Engines Stopped and Brakes Set on Park er d Cars. No
person having control of a motor vehicle shall allow such vehicle to
stand on any street unattended without first effectively setting the
brakes thereon and stopphe motor of said vehicle, and when standing
upon any grade without turning the front wheels of such vehicle to the
curb or side of the street.
Section 45. Duty to Stop in Event of Accident. The driver of
any vehicle involved in an accident resulting in damage to property
shall imuLiediately stop such vehicle at the scene of such accident.
2:5 Section 47. Driver to Give Jrfor_nation of Accident and Assam ist
InjLured. The driver of any vehicle involved in any accident resulting
in injury or death to any person or damage to any property shall also
give his name, address, the registration number of his vehicle and exhibit
his chauffeur's license to the person struck or the driver or occupants of
any vehicle collided with and shall render to any person injured in such
accident reasonable assistance, including the carrying of such person to
a physician or surgeon for medical or surgical treatment if it is ap-
parent that such treatment is necessary or is requested by the injured
person.
Section 48. Duty to Report Accidents. The driver of any vehicle
involved in an accident resulting in injury or death to any person or
property damage to the extent of $50.00 or more shall within twenty —four
hours report such accident to police headquarters.
,�- Section 49. Garage Keepers to Report Damaged Vehicles. The person

in charge of any garage or repair shop in Little Rock to which is brought
any motor vehicle which shows evidence of having been involved in a
serious accident or struck by any bullet shall report same to police
headquarters within twenty —four hours after such motor vehicle is re-
ceived, giving the engine number, registration number and the none and
address of the owner or operator of such vehicle.
f Section 50. Rubber Tires dust Be Intact. Every solid rubber tire
on a vehicle moved on any street shall have rubber on its entire traction
surface at least one inch above the edge of the flange of its entire
circumference.
Section 51. Driving Through Safety Zones. The driver of a vehicle
shall not at any time drive through, across or over a safety zone.

'Section 58. Tires Not to have Blocks Cleats, Spikes, Etc.
yo tire on a vehicle moved on a street in Little Rock shall have on
its traction surface any block, stud, flange, cleat or spike or any
other protuberances of any material other than rubber which projects
beyond the tread of the traction surface of there, except that it
shat- be permissible to use farm machinery with tires having pro-
tuberances which will not injure the streets and except also, that
it shall be permissible to use tire chains of reasonable proportions
upon any vehicle when required for safety because of snow, ice or other
conditions tending to cause a vehicle to slide or skid.
6 Section 53. Bra.. Every motor vehicle when operated upon a
street in Lit-tie Rock shall be equipped with brakes adequate to control
the movement of and to stop and to hold such vehicle, including two
separate means of applying the brakes, each of which means shall be
effective to apply the brakes to at least two wheels and so const2.cted.
that no part which is liable to failure shall be common to the two ex-
cept that a motorcycle need be equipped with only one brake. All such
brakes shall be maintained in good working order.
.-� Section 54. Horns and Warning Devices.
Every motor vehicle when
operated upon a street in Little Rock shall be equipped with a horn in
good working order capacle of emitting sound audible under normal co:.-
ditions from a distance of not less than two hundred feet, and it shall
be unlawful for any vehicle to be equipped with or for any person to
use upon a vehicle any siren, exhaust, covpression or spark plug whistle
or for any person at any time to use a horn otherwise than as a reasoir-
aple warning or to make any unnecessary or unreasonably loud or harsh
sound by means of a horn or other warning device.
,,...'' Section 56. Windshields 2dust Be Unobstructed. It shall be unlawful
for any person to drive any vehicle upon a. street in Little Rock with
any sign, poster or other non- transarent material upon the front wind-
shield, side wings, side or rear windows of such motor vehicle.
Section 56, Windshield Wiper Required. Every windshield on a motor
vehicle shall be equipped with a device for cleaning rain, snow or other
moisture from the windshield which device shall be so constructed as to
be controlled or operated by the driver of the vehicle.

vehicle on a street in Little Rock unless such vehicle is equipped with
a muffler in good working order and in constant o_aeration to prevent
excessive or unusual noise and annoying smoke.
1 Section 58. Vehicles Must Not Litter Street. No vehicle shall be

driven or moved on any street in Little Rock unless such vehicle is so
constructed or loaded as to prevent its contents fro %dropping, sifting,
leaking, or otherwise escaping therefrom.
Section 59. �Phen Lights. Required. Every vehicle upon a street or

alley in Little Rock during the period from a kialf hour after sunset to
a half hour before sunrise and at any other time when there is not suffio-
ient light to render clearly discernible any person on the street at I,
a, distanoe of 200 feet ahead, shall be equipped with lighted front and
rear lamps.
Section 80, Front Lights Required. Every motor vehicle other than
a motorcycle shall be equipped with two head lamps, no more and no less,
at the front of and on opposite sides of the motor vehicle. Said lamps
shall be so constructed, arranged and adjusted that they will at all
times aild under normal atmospheric conditions and on a level street
produce a driving light sufficient to render clearly discernible a person
200 feet ahead, but shall not project a glaring or dazzling light to per-
sons in front of such vehicle. None of the main bright portion of the
head lamp beams shall rise above a horizontal plane passing through the
lamp centers parallel to the level street upon which the vehicle stands
and in no case higher than forty -two inches, seventy -five feet ahead of
the vehicle.
Section fl. Fron # Lamps on bro orcycles. Every motorcycle shall be
equipped with at 'least one and not more than two head lamps whit , shall
comply with Sections 59 and 60 of this ordinance.
Section 62. R� L Every motor vehicle and. every trailer or
semi- trailer which is being drawn at the end of a train of vehicles
shall carry at the rear a lamp which exhibits a red or yellow light
plainly visible under normal atmospheric conditions from a distance of
500 feet to the rear of such vehicle and be so constructed and placed
that the number plate carried on the rear of such vehicle shall_ under

like conditions be so illuminated by a white light as to be read from
a distance of fifty feet to the rear of such vehicle.
,to Section. 63. Lamps on Bicycles. Every bicycle shall be equipped
with a lighted lamp on the front thereof visible under normal atmos-
pheric conditions from a distance of at least three hundred feet in front
of such bicycle and shall also be equipped with a reflex mirror or lamp
on the rear exhibiting a red or yellow light visible under like con-
ditions from a distance of at least two hundred feet to the rear of
such bicycle.
,rg Section 64, Lights on Other Vehicles. All vehicles not heretofore
in this ordinance required to be equipped with specified lighted lamps
shall carry one or more lighted lamps or lantern displaying a white
light visible under normal atmospheric conditions from a distance of
not less than 500 feet to the front of such vehicle and displaying a
yellow or red light visible under like conditions from a distance of
not less than 500 feet to the rear of such vehicle.
Section 66. Lamps to Comply with State Highway Regulations. All
lamps on all motor vehicles used in the City of Little Rock shall be
of a type and construction approved by the Highway Commissioner of the
State of Arkansas.
Section 66, Violations Shall Be Misdemeanors. It shall be unlawful
and constitute a misdemeanor for any person to violate any of the pro-
visions of this ordinance unless such violation is by this ordinance or
other law of this state declared to be a, felony.
Section 67. Penalties for Misdemeanors. Every person convicted of
a misdemeanor for violation of any of the provisions of this ordinance
for whidhh another penalty is not provided, shall. upon conviction (hereof
be punished by a fine of not more than one hundred dollars or by impris-
onment in the municipal jail for not more than ten days; for a second
such conviction within, one year thereafter such person shall be punished
by a fine of not more than two hundred dollars or by imprisonment in the
municipal jail for not more than twenty days, or both such fine and
imprisonment; and,upon a third or subpequent conviction within one year
after the first conviction such person shall be punished by a fine of
not more than five hundred dollars or by imprisonment in the municipal

jail for not more than six months, or by both such fine and imprisonment.
Section 68. Appearance Upon Arrest for Misdemeanor. Whenever any
person is arrested for a violation of any provision of this ordinance
punishable as a misdemeanor, the arresting officer shall take the name
and address of such person and the license number of his motor vehicle
and issue a sumplons or otherwise notify him in writing to appear at a
time and place to be specified in such summons or notice, such time to
be at least five days after such arrest unless the person.arrested shall
demand an earlier hearing, and such person sY�all, if he so desir.es, have
a right to a hearing at the next session} of the Juniaipal Court. Such
II officer shall thereupon and upon the giving by s,*c'h -�ersor of his written
promise to appear at such time and place forth,vith, relewse rim from

hour outside of a business or residence district, or any person charred
with driving while under the influence of intoxicating liquor or narcotic
drugs, or any person whore the arresting officer shall have good cause to
believe has committed any felony, shall be brought immediately by the
arresting officer to Police Headquarters.
r Section 69. Violating 77ritten Promise to Appear Shall Be Misdemeanor.
Any person wilfully violating his written promise to appear, given in
accordance with Section 68 of this ordinance shall be guilty of a misde-
meanor regardless of the disposition of the charge upon which he was
originally arrested.
Section 70. Repealing. Sections 5, o, 71 8, 9, 10, 12, 131 21, 22,
23, 25, 26, 28, 29, 332, 3, 37, 39, 40, 54, 57, 58, 591 60, 611 621 671
681 691 701, 79, 83, 90 and 101 of Ordinance 3913 are hereby repealed.
All ordinanced and paxts of ordinances in conflict herewith are repealed
and this ordinance shall take effect and be in .force from and after its
passage.
