AN ORDINANCE AUTHORIZING SEIZURE BY POLICE DMDART': ANT OF ALL
MOTOR VEHICLES ABANDONED ON THE STREETS OF LITTLE ROCK, AND
PROVIDING FOR THE SALE THEREOF, AND FOR OTHER PURPOSES:
INHEREAS, a number of motor vehicles are abandoned on
the streets of Little Rock ever; year, and are never re- claimed
or identified by their owners, which necessitates the seizure
of said vehicles by the police department and the paying of
storage on them by the City of Little Rock, therefore;
BE IT ORDAIN ?ED BY THE CITY COUINXIL OF THE CITY OF LITTLE ROCK:
Section 1. Any motor vehicle abandoned on the streets
of the city of Little Rock shall be seized by any member of the
police department, and if the owner shall,within twenty -four
hours after being notified, appear and claim his motor vehicle,
it shall be returned ur�on proper indentification and proof of
ownership, without any cost to said owner. And if the owner of
any abandoned motorvehicle is unknown, the ohief of police shall
canesswi,itten notice to be posted in six public places and published
in some local newspaper by two insertions for a period of two weeks.
If ownership is established after notice has been posted and
published by chief of police, said motor vehicle shall be returned
to the owner thereof upon payment of all storage charges and cost
of posting and publishing notice.
Section 2. All abandoned motor vehicles,seized under section
one of this ordinance, remaining unclaimed for a period of thirty
days or more, shall be sold by the oh6f of police at public
ate sale after nSYtiae�,, describing said motor vehicles and
naming date of sale, has been published in some local newspaper
once a week for four consecutive weeks, and the proceeds of said
first
sale shall /be applied to the payment of storage, posting and
publishing notices and advertising sale, and the balance, if any,
shall be turned over to the city collector and held subject to
the claim of the proper person entitled thereto, who may apply
therefor to the city council within six months thereafter; anA
if such p ersoA right to the residue of the proceeds of said sale
is established, the city council shall order the city clerk to
draw a warrant in favor of such person covering same.
Section 3. No part of this ordinance shall be construed
as prohibiting anyone re- claiming an abandoned motor vehicle,
upon proper proof of ownership, before sale has been consummated
in accordance with section two of this ordinance.
Section 4. All ordinances and parts of ordinances in
conflict herewith are hereby repealed, and this ordinance being
necessary for the protection of the public peace, health and
safety, shall take effect and be in force from and after its
passaged
