TO AUTHORIZE THE MAY OR AND CITY CLERK v
EXECUTE A QUITCLAIM DEED TO GREENLEAF HOLDINGS, LLC; AND
FOR OTHER PURPOSES.
. WHEREAS, on June 2, 2004, Greenleaf Holdings provided to the City a warranty deed for right -of-
way and a temporary construction easement along 12th Street in connection with the widening of the
street through the Fair Park Boulevard Street Widening Project (I -630 - 12th Street) , and
WHEREAS, a question has arisen as to whether the property to be conveyed was identified correctly,

12 WHEREAS, to eliminate any ambiguity and to fulfill the clear intent of the parties for the City to
13 acquire only new right -of -way and a temporary construction easement on the property owned by
14 Greenleaf Holdings on 12th Street, it is desirable for the City to provide a quitclaim deed to Greenleaf
15 Holdings for any property it may have in error deeded to the City beyond the requested right -of -way.
16 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY
17 OF LITTLE ROCK, ARKANSAS:
18 Section 1. The Mayor and City Clerk are hereby authorized to execute, in a form approved by the
19 City Attorney, a quitclaim deed and any other documents required to convey to Greenleaf Holdings, LLC
20 certain property described as follows:
21 Part of the SW1 /4 SE1 /4 SE1 /4 SW1 /4 of Section 6, Township 1 North, Range 12 West, in
22 the City of Little Rock, Pulaski County, Arkansas, described as follows: Begin at a point
23 30 feet North and 220 feet East of the Southwest corner of said SW1 /4 SE1 /4 SE1 /4
24 SW1 /4; thence North 144.7 feet; thence East 120 feet; thence South 144.7 feet; thence West
25 120 feet to the point of beginning, LESS AND EXCEPT beginning at the Southwest
26 corner of above described property; thence along the West line thereof North 02 degrees
27 06 minutes 33 seconds East 4.72 feet; thence leaving the West line South 87 degrees 40
28 minutes 18 seconds East 58.44 feet; thence South 83 degrees 44 minutes 11 seconds East
29 25.30 feet to the P.C. of a 20.00 ft. radius curve to the left; thence 22.71 feet along the
30 curve for a chord bearing and distance of North 37 degrees 06 minutes 05 seconds East
31 22.51 feet; thence leaving the curve South 87 degrees 53 minutes 27 seconds east 20.00
32 feet to the East line of said above described parcel, thence along the East and South lines
33 thereof, South 02 degrees 06 minutes 33 seconds West 20.00 feet; thence North 87
34 degrees 53 minutes 27 seconds West 120.00 feet to the point of beginning.

36 Section 2. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
37 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or
38 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and

effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the
resolution.
Section 3. Repealer. All laws, ordinances, resolutions, or parts of the same, that are inconsistent
with the provisions of this resolution, are hereby repealed to the extent of such inconsistency.
