RESOLUTION NO. 12,960
A RESOLUTION AUTHORIZING THE USE OF
EMINENT DOMAIN FOR THE ACQUISITION OF
RIGHT -OF -WAY FOR THE VIMY RIDGE AND
ALEXANDER ROAD SIGNAL
WHERAS, attempts to acquire right -of -way and temporary construction easements
necessary for construction of the Vimy Ridge Road and Alexander Road Signal at fair
market value have been unsuccessful,
AND, efforts will continue to acquire necessary property without the use of eminent
domain.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF
THE CITY OF LITTLE ROCK, ARKANSAS:
SECTION 1. The City Manager is hereby authorized to use eminent domain to
complete acquisition of right -of -way for this project.
SECTION 2. Funding for project is available from 314409 S40SR39. Estimated total
project amount: $280,000
SECTION 3. Severability. In the event any title, section, paragraph, item, sentence,
clause, phrase, or word of this resolution is declared or adjudged to be invalid or
unconstitutional, such declaration or adjudication shall not affect the remaining portions
of the resolution which shall remain in full force and effect as if the portion so declared
or adjudged invalid or unconstitutional was not originally a part of the resolution.
SECTION 4. Repealer. All laws, ordinances, resolutions, or parts of the same, that are
inconsistent with the provisions of this resolution, are hereby repealed to the extent of
such inconsistency.
SECTION 5. This resolution will be in full force and effect from and after the date of its
adoption.
