3 A RESOLUTION TO HOLD A PUBLIC HEARING ON APRIL 7, 2009 FOR
4 PUBLIC COMMENT ON THE PROPOSED EXPENDITURES FROM THE
5 EDWARD BYRNE JUSTICE ASSISTANCE GRANT; TO AUTHORIZE THE
6 CITY TO SIGN THE NECESSARY AGREEMENTS WITH PULASKI COUNTY,
7 NORTH LITTLE ROCK, JACKSONVILLE, SHERWOOD, AND MAUMELLE
8 TO PARTICIPATE IN THE RECOVERY ACT EDWARD BYRNE JUSTICE
9 ASSISTANCE GRANT; AND FOR OTHER PURPOSES.

11 WHEREAS, the Joint Application Award amount announced in the Recovery Act Edward Byrne Justice
12 Assistance Grant Local Solicitation for the City of Little Rock, the City of North Little Rock, the City of
13 Jacksonville, the City of Sherwood, the City of Maumelle, and Pulaski County totals $2,897,792; and
14 WHEREAS, the parties have agreed that the funds will be distributed as follows: $1,907,580 to the City of
15 Little Rock; $495,342 to the City of North Little Rock; $146,917 to the City of Jacksonville, $66,835 to the City of
16 Sherwood, $30,236 to the City of Maumelle, and $250,882 to Pulaski County; and
17 WHEREAS, the parties have agreed that the City of Little Rock will submit the joint application on behalf of
18 the jurisdictions, but that each party will comply with the certifications, administrative, and reporting requirements
19 as outlined in the Grant Program; and
20 WHEREAS, the City is required to hold a public hearing in order that the Police Department may advise the
21 public regarding proposed expenditures under the grant and receive public comment on the proposed expenditures.
22 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF
23 LITTLE ROCK, ARKANSAS:
24 Section 1. The City will hold a public hearing on April 7, 2009 at the City Board Meeting for the purpose of
25 hearing from the Police Department about the proposed expenditure of funds under the Byrne Grant and will receive
26 public comments on the proposed expenditures at that time.
27 Section 2. The City is authorized to sign the necessary agreements to participate in the Recovery Act Edward
28 Byrne Justice Assistance Grant with the Cities of North Little Rock, Jacksonville, Sherwood, Maumelle, and Pulaski
29 County. The agreements shall specify the responsibilities of the governmental entities pursuant to the statutes, rules
30 and regulations governing the grant award and adequately protect the City of Little Rock from potential claims made
31 by the federal government arising from non - compliance from the various participants.
32 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this
33 resolution is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect
34 the remaining portions of the resolution which shall remain in full force and effect as if the portion so declared or
35 adjudged invalid or unconstitutional was not originally a part of the resolution.
36 Section 4. Repealer. All laws, ordinances, resolutions, or parts of the same, that are inconsistent with the
37 provisions of this resolution, are hereby repealed to the extent of such inconsistency.

Section 5. This resolution will be in full force and effect from and after the date of its adoption.
