3 A RESOLUTION TO AUTHORIZE THE MAYOR AND CITY CLERK TO EXECUTE
4 DOCUMENTS NEEDED TO CONVEY A 10 -FOOT WIDE STRIP OF FORMER ALLEY
5 LYING EAST OF LOTS 1, 2 AND 3 OF BLOCK 116, ORIGINAL CITY OF LITTLE
6 ROCK, TO PB CAPITOL PROPERTIES, LLC; AND FOR OTHER PURPOSES.

8 WHEREAS, on February 20, 1961, pursuant to Little Rock Ordinance No. 11,152, the City
9 vacated and abandoned a 20 -foot wide alley in Block 116, Original City of Little Rock, and
10 WHEREAS, Ordinance No. 11,152 specifically provided that the absolute ownership of each side
11 of the 20 -foot strip in Block 116 was to vest, subject to the existing telephone and electric power
12 easements, in the abutting owners, and
13 WHEREAS, it has now come to the attention of the City that a deed for the 10 -foot strip of
14 alley east of and abutting Lots 1, 2, and 3 of Block 116 was never provided by the City to the owner of
15 such lots, despite the clear intent provided in the ordinance for the transfer of ownership.
16 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE
17 ROCK, ARKANSAS:
18 Section 1. The Mayor and City Clerk are hereby authorized to execute, in a form approved
19 by the City Attorney, a quitclaim deed and other documents as required to convey to PB Capitol
20 Properties, LLC, certain property described as follows:
21 A 10 -foot wide strip of land formerly an alley lying East of Lots 1, 2, and 3, and which was
22 closed and vacated by City of Little Rock Ordinance No. 11,152, a certified copy of same being
23 of record in Deed Book 755, Page 597, records of Pulaski County, Arkansas, all in Block 116,
24 Original City of Little Rock, Arkansas.
25 Section 2. Severability. In the event any title, section, paragraph, item, sentence, clause,
26 phrase, or word of this resolution is declared or adjudged to be invalid or unconstitutional, such
27 declaration or adjudication shall not affect the remaining portions of the resolution which shall remain
28 in full force and effect as if the portion so declared or adjudged invalid or unconstitutional were not
29 originally a part of the resolution.

Section 3. Repealer. All
laws, ordinances, resolutions,
or parts of the same, that are
31
inconsistent with the provisions of
this resolution, are hereby
repealed to the extent of such
32
inconsistency.
