12735I RESOLUTION NO. 12,735 2 3 A RESOLUTION TO APPROVE AN ANNUAL CONTRACT WITH CRANFORD 4 CONSTRUCTION CO., PRIMARY VENDOR, AND JAY PAC, INC., SECONDARY 5 VENDOR, FOR THE PURCHASE OF ASPHALTIC MATERIALS FOR THE 6 OPERATIONS STREET DIVISION OF THE PUBLIC WORKS DEPARTMENT; AND 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 FOR OTHER PURPOSES. WHEREAS, the City advertised formal bids to solicit proposals for an annual contract for asphaltic materials for the Operations Street Division of the Public Works Department, and Cranford Construction Co., and Jay Pac, Inc. submitted the two most responsible and responsive bids, respectively, and WHEREAS, the contract, which contains an escalation clause due to fluctuating prices of petroleum oils, is for one (1) year from date of award, and may be extended yearly for two (2) additional years, upon agreement of the parties; NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: Section 1. The City Manager is authorized to enter into agreements with Cranford Construction Co., as primary vendor, and Jay Pac, Inc., as secondary vendor, in the approximate amount of Seventy -five Thousand Dollars ($75,000.00), depending upon the fluctuating prices of petroleum oils, for the annual contract for asphaltic materials for the Operations Street Division of the Public Works Department. Section 2. Funds for this agreement are to be allocated from Account No.204003- 61020. Section 3. Severability. In the event any portion of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of this resolution, which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of this resolution. Section 4. Repealer. All ordinances and resolutions, and parts thereof, which are in conflict with any provision of this resolution are hereby repealed to the extent of such conflict.
