3 A RESOLUTION TO AUTHORIZE THE MAYOR AND CLERK TO EXECUTE A
4 PARTIAL RELEASE OF A SEWER EASEMENT IN LOTS 33, 34, 35 AND 36, IN
5 BLOCK 96, CHENAL VALLEY ADDITION IN THE CITY. OF LITTLE ROCK,
6 ARKANSAS; AND FOR OTHER PURPOSES.

8 WHEREAS, on August 20, 1990, Deltic Farm >=t Timber Co. Inc. provided a Right -of -Way Easement to
9 the City of Little Rock on its property located in Chenal Valley in Pulaski County for future sewer needs
10 and facilities, and
11 WHEREAS, subsequently, a 20 -foot sewer easement in the same general area was provided to the
12 City by Deltic Farm it Timber Company Co. Inc. pursuant to a plat of the Hallen Court Addition to the
13 City of Little Rock, which was filed for record on November 16, 2005 as Document No. 2005097402 in
14 Plat Book H, page 545, and a sewer line was then constructed within the easement in the substituted
15 location as indicated on the recorded plat, and
16 WHEREAS, the Public Works Department and the Sanitary Sewer Committee have determined that
17 there is no need for the sewer easement in Lots 33 through 36 of Block 96, Chenal Valley Addition since
18 a substitute easement in the area was provided and accepted by the City through the plat of Chenal
19 Valley Addition.
20 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTQRS OF THE CITY OF LITTLE
21 ROCK, ARKANSAS:
22 Section 1. The Mayor and City Clerk are hereby authorized to execute a Partial Release of
23 Easement, in a form approved by the City Attorney, abandoning and relinquishing any right, title and
24 interest the City has in Lots 33, 34, 35, and 36, Block 96, Chenal Valley Addition to the City of Little
25 Rock, Arkansas as described in the Right -Of -Way Easement dated August 20, 1990 and recorded on
26 September 4, 1990 in the real estate records of the Circuit Clerk and Recorder of Pulaski County,
27 Arkansas as Instrument No. 90- 49437, as shown on the map on Exhibit A attached hereto.
28 Section 2. Severability. In the event any title, section, paragraph, item, sentence, clause,
29 phrase, or word of this resolution is declared or adjudged to be invalid or unconstitutional, such
30 declaration or adjudication shall not affect the remaining portions of the resolution which shall remain
31 in full force and effect as if the portion so declared or adjudged invalid or unconstitutional were not
32 originally a part of the resolution.
33 Section 3. Repealer. All laws, ordinances, resolutions, or parts of the same, that are inconsistent
34 with the provisions of this resolution, are hereby repealed to the extent of such inconsistency.
