ORDINANCE OF THE BOARD OF DIRECTORS OF THE CITY
OF LITTLE ROCK, ARKANSAS, VACATING AND CLOSING
A PORTION OF AN ALLEY, SAID PORTION LYING WEST
OF THE EAST LINE EXTENDED SOUTH OF A PARCEL OF
LAND DESCRIBED AS OUTLOT "Ai" (EXCEPT THE EAST
38 FEET THEREOF), PROSPECT TERRACE ADDITION #3
TO THE CITY OF LITTLE ROCK, ARKANSAS
WHEREAS, a petition was duly filed with the Board of
Directors of the City of Little Rock, Arkansas, on the 14th
day of August, 1963, asking the Board of Directors to vacate
and abandon a portion of the alley lying west of the east
line extended south of a parcel of land described as Outlot
"A " (except the east 38 feet thereof), Prospect Terrace Addi-
tion #3 to the City of Little Rock, Arkansas, as designated
on the plat of said Addition now appearing of record in Plat
Book 3, page 52, in the office of the Recorder of Pulaski
County, Arkansas, subject, however, to any public easements
in said portion of alley; and
WHEREAS, after due notice as required by law, the
Board of Directors has, at the time and place mentioned in
the notice, heard all persons desiring to be heard on the
question and has ascertained that the portion of alley here-
inafter described has heretofore been dedicated to the public
use as an alley; has not been actually used by the public
generally for a period of at least five (5) years subsequent
to the filing of the plat; that all of the owners of the pro-
perty abutting upon the portion of alley to be vacated have
consented to such abandonment; and that public interest and
welfare will not be adversely affected by the abandonment
of such portion of alley.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIREC-
TORS OF THE CITY OF LITTLE ROCK, ARKANSAS:
SECTION 1. The City of Little Rock, Arkansas, hereby
releases, vacates and abandons all its rights, together with
the rights of the public generally, in and to the portion of
alley designated as follows:
All that portion of an alley in Prospect Terrace
Addition #3 to the City of Little Rock lying west
of east line extended south of Outlot "A" (except
the east 38 feet thereof), Prospect Terrace Addi-
tion #3 to the City of Little Rock, Arkansas.
(All as shown by plat of record in Plat Book 3
at page 52).
subject, however, to any public utility easements located
in said portion of alley.
SECTION 2. A copy of this Ordinance, duly certified
by the City Clerk, shall be filed in the office of the Recor-
der of Pulaski County and recorded in the Deed Records of
the County.
SECTION 3. This Ordinance shall take effect and be
in force from and after its passage.
