126571 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 RESOLUTION NO. 12,657 A RESOLUTION AMENDING RESOLUTION NO. 12,653 TO CORRECT THE AMOUNT OF THE CONTRACT WITH GAMETIME BY SOUTHWEST PARKS AND PLAYGROUNDS FOR SUPPLY AND INSTALLATION OF POURED -IN -PLACE SURFACING FOR THE RIVERFRONT ADVENTURE PARK; AND FOR OTHER PURPOSES. WHEREAS, certain surfacing is needed for the Riverfront park adventure park, and WHEREAS, bids, channeled through U.S. Communities, a community purchasing agency for cities across the country, were taken and Gametime by Southwest Parks and Playgrounds was competitively selected to supply and install the poured -in -place surfacing needed for the park, and WHEREAS, the Board previously approved the purchasing of the surfacing pursuant to Little Rock, Ark. Res. No. 12,653 (February 19, 2008) in the maximum amount of $80,876.35, and WHEREAS, the quoted price of $80,876.35 for the surfacing did not include the cost for a performance and payment bond, which is required by state law and which is protective of the City's interests, nor did it include sales tax. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: Section 1. Section 1 of Resolution No. 12,653 (February 19, 2008) is hereby amended to change the authorized amount of the contract to a maximum amount of $88,963.98, which includes the amount of the needed payment and performance bond. Section 2. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the resolution which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the resolution. Section 3. Repealer. All laws, ordinances, resolutions, or parts of the same, that are inconsistent with the provisions of this resolution, are hereby repealed to the extent of such inconsistency.
