19897I ORDINANCE NO. 19,897 2 3 AN ORDINANCE TO ABANDON A PORTION OF THE ALLEY LOCATED IN 4 BLOCK 360 AND 361 OF THE ORIGINAL CITY OF LITTLE ROCK, ARKANSAS, 5 AS PUBLIC RIGHT -OF -WAY; AND FOR OTHER PURPOSES. 6 WHEREAS, a request was made to vacate and abandon a portion of the alley located in Block 360 7 and block 361 of the Original City of Little Rock, including all easements, as public right -of -way, 8 pursuant to the City's general police power authority under Ark. Code Ann. 5 14 -54 -104; and 9 WHEREAS, the Board has determined that the abandoning of this public right -of -way will not have 10 an adverse impact on the adjacent property owners nor the local traffic, and therefore, the right -of- 11 way abandoned by this ordinance is no longer needed for corporate purposes, except as otherwise 12 noted below; 13 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE 14 ROCK, ARKANSAS: 15 Section 1. The Board of Directors hereby releases, vacates, and abandons a portion of the alley 16 located within Block 360 and Block 361, of the Original City of Little Rock as follows: The North /South 17 alley located between Blocks 360 and 361 adjacent to Lot 17, Block 360 and Lot 12, Block 361, with the 18 applicant to receive 5 -feet of the alley and the abutting property owner to receive the remaining 5- 19 feet; the East /West alley located adjacent to Lots 1 -12, Block 361, with the applicant being the sole 20 owner of the lots adjoining the alley. 21 Section 2. The City specifically reserves the public utility and drainage easements within the 22 former right -of -way. 23 Section 3. A copy of this ordinance, duly certified by the City Clerk, shalt be filed in the real 24 estate records of the recorder of the Circuit Clerk in ex officio recorder of Pulaski County, Arkansas. 25 Section 4. Severability. in the event any title, section, paragraph, item, sentence, clause, 26 phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such 27 declaration or adjudication shall not affect the remaining portions of the ordinance which shall remain 28 in full force and effect as if the portion so declared or adjudged to be invalid or unconstitutional was 29 30 31 32 33 34 35 36 37 not originally a part of the ordinance. Section 5. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
