198991 ORDINANCE NO. 19,899 2 3 AN ORDINANCE TO AMEND LITTLE ROCK, ARK., REV. CODE S 32 -301 (1988) ; 4 TO ESTABLISH FINES FOR VEHICLES ILLEGALLY PARKED IN METERED AND 5 UNMETERED SPACES;; TO DECLARE AN EMERGENCY; AND FOR OTHER 6 PURPOSES. 7 WHEREAS, the City has established by ordinance the fines to be assessed for motor vehicles 8 illegally parked in metered and unmetered restricted parking spaces; and 9 WHEREAS, after consideration of several issues such as the number of years since the parking fine 10 was raised, the cost to the City to operate and maintain parking meters, and the cost to the City to 11 assure enforcement of various parking codes, it has been determined that an increase in the amounts 12 charged by the City is appropriate, and that the following fee structure is reasonably related to the 13 benefits received by the persons who pay these fees. 14 NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, 15 ARKANSAS: 16 Section 1. Little Rock, Ark. Rev. Code 5 32 -301 (1988) is hereby amended to read as follows: 17 The penalty for violation of overtime parking in all metered and unmetered restricted parking 18 areas shall be: 19 (a) Fifteen dollars ($15.00) if paid within thirty (30) days of the issuance of the ticket: 20 (b) Fifty dollars ($50.00) if paid after thirty (30) days of the issuance of the ticket, or after 21 conviction in district court for violation of city parking ordinances. 22 A combination ticket and envelope shall be provided at the issuance of a violation citation for 23 the convenience of motorists. The penalty shall be paid by placing such sum in the penalty box 24 attached to the parking meters, or by paying the fine to the city. 25 Section 2. Severability. In the event that any title, section, paragraph, item, sentence, clause, 26 phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such 27 declaration or adjudication shall not affect the remaining portions of the ordinance which shall remain 28 in full force and effect as if the portion so declared or adjudged invalid or unconstitutional was not 29 originally part of the ordinance. 30 Section 3. Repealer. All ordinances, resolutions, by -laws, and other matters inconsistent with this 31 ordinance are hereby repealed to the extent of such inconsistency. 32 Section 4. Emergency. The Board of Directors finds that a reasonable increase in the amount of 33 overtime parking fines will increase the City's ability to effectively regulate on street parking within 34 the various areas of the City, and to assure that any off- street parking in restricted areas is properly 35 controlled; such effective regulation is essential to maintain the public health, safety and welfare of [PAGE 1 OF 2] Ordinance To amend the City Code on parking fines 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 the citizens of Little Rock, therefore an emergency is hereby declared to exist and this ordinance shall be in full force and effect from and after the date of its passage.
