198861 ORDINANCE # 19,886 2 3 AN ORDINANCE TO AMEND CHAPTER 3, ARTICLE II OF THE LITTLE ROCK 4 CODE, 1988, TO ADD CERTAIN CRITERIA FOR WAIVING OR REDUCING FALSE 5 ALARM CIVIL PENALTIES; AND FOR OTHER PURPOSES. 6 7 WHEREAS, the Little Rock Board of Directors passed the False Alarm Reduction Ordinance 8 (Ordinance No. 19,331) on June 7, 2005 to reduce false alarms, and 9 WHEREAS, the purpose of the False Alarm Reduction Ordinance is not to raise revenue, but to 10 reduce false alarms by encouraging alarm users in the City to take steps to prevent false alarms from 11 occurring, and 12 WHEREAS, the Ordinance does not mention that the alarm administrator or the false alarm appeals 13 panel may adjust civil penalties based upon evidence that an alarm user took steps to have the alarm 14 system repaired or replaced by a qualified professional upon notification of false alarms by the alarm 15 administrator. 16 NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, 17 ARKANSAS: 18 Section 1. Little Rock Code 1988, Chapter 3, Article II, Section 3 -22(g) is hereby amended add a 19 new subparagraph (6) as follows: 20 "(6) Written evidence that the Alarm User, upon being notified by the Alarm 21 Administrator that false alarms have been caused by user's alarm system, contracted 22 with a qualified professional to make necessary repairs or maintenance to the alarm 23 system in an effort to fix any defective portion of the system and /or completely 24 replace the alarm system. The dollar amount in Civil Penalties reduced by the Alarm 25 Administrator shall not exceed the dollar amount the Alarm User paid for equipment, 26 parts, and /or labor for the repairs. All subsequent civil penalties after the waiver date 27 are once again the responsibility of the alarm user." 28 Section 2. Little Rock Code 1988, Chapter 3, Article II, Section 3 -25 is hereby repealed. 29 Section 3. In the event that any title, section, paragraph, item, sentence, clause, phrase, or word 30 of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or 31 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force 32 and effect as if the portion so declared or adjudged invalid or unconstitutional was not originally part 33 of the ordinance. 34 Section 4.
