3 AN ORDINANCE TO ABANDON 40 FEET OF EXCESS SCOTT HAMILTON DRIVE
4 RIGHT—OF—WAY LOCATED ADJACENT TO 5800 SCOTT HAMILTON DRIVE, IN
5 THE CITY OF LITTLE ROCK, ARKANSAS, AS PUBLIC RIGHT—OF—WAY; AND
6 FOR OTHER PURPOSES.
7 WHEREAS, a request was made to vacate and abandon 40 feet of excess Scott Hamilton Drive
8 right-of-way (40 feet by 985.36 feet) located adjacent to 5800 Scott Hamilton Drive, retaining the
9 utility and drainage easements, as public right-of-way, pursuant to the City's general police power
10 authority under Ark. Code Ann. 5 14-54-104; and
11 WHEREAS, the Board has determined that the abandoning of this public right-of-way will not
12 have an adverse impact on the adjacent property owners nor the local traffic, and therefore, the right-
13 of-way abandoned by this ordinance is no longer needed for corporate purposes, except as otherwise
14 noted below;
15 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE
16 ROCK, ARKANSAS:
17 Section 1. The Board of Directors hereby releases, vacates, and abandons 40 feet of excess
18 Scott Hamilton Drive right-of-way (40 feet by 985.36 feet) located adjacent to 5800 Scott Hamilton
19 Drive.
20 Section 2. The City specifically reserves the public utility and drainage easements within the
21 former right-of-way.
22 Section 3. A copy of this ordinance, duly certified by the City Clerk, shall be filed in the real
23 estate records of the recorder of the Circuit Clerk in ex officio recorder of Pulaski County, Arkansas.
24 Section 4. Severability. In the event any title, section, paragraph, item, sentence, clause,
25 phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such
26 declaration or adjudication shall not affect the remaining portions of the ordinance which shall remain
27 in full force and effect as if the portion so declared or adjudged to be invalid or unconstitutional was
28 not originally a part of the ordinance.
29 Section 5. Repealer. All laws, ordinances, resolutions, or parts of the same that are
30 inconsistent with the provisions of this ordinance are hereby repealed to the extent of such
31 inconsistency.
