198831 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 ORDINANCE NO. 19,883 AN ORDINANCE TO AMEND CHAPTER 30 OF THE CODE OF ORDINANCES OF THE CITY OF LITTLE ROCK, ARKANSAS, PROVIDING FOR A DEFERRAL OF MASTER STREET PLAN CONSTRUCTION REQUIREMENTS FOR CHENAL PARKWAY AND HIGHWAY 10; AND FOR OTHER PURPOSES. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: Section 1. Chapter 30 of the Code of Ordinances is amended to provide for a deferral of certain requirements within the Master Street Plan until a future phase of development, or until the adjacent property along Chenal Parkway and Highway 10 is developed. The property is within the preliminarily platted Northwest Territory Addn. located on the north side of Highway 10 on both sides of Chenal Parkway. Subsection a. Chapter 30 Article VI requiring developers to construct roadway improvements to the requirements of the Master Street Plan will be deferred until lot 10 develops, for a period of five (5) years, until traffic counts reach 12,000 ADT, or until adjacent development along Chenal Parkway occurs, whichever occurs first. Boundary street improvements will be constructed on Chenal Parkway and Hwy 10 along the frontage of lot 10 now. The specific deferral is for constructing approximately 1250 linear ft of widening of one and one half lanes, curb and gutter, sidewalks, drainage, street lights on the east side of Chenal Parkway between the north property line of lot 2 and the north property line of lot 10. Subsection b. Chapter 30 Article VI requiring developers to construct roadway improvements to the requirements of the Master Street Plan will be deferred on lots 1, 2, 3, 5, 6, 7, 8, and 9A until lot 9 develops, for a period of five (5) years, until traffic counts reach 12,000 ADT, or until adjacent development along Chenal Parkway and Highway 10 occurs, whichever occurs first. The specific deferral is for constructing approximately 4850 linear ft of widening for one and one half lanes, curb and gutter, sidewalks, drainage, street lights and intersection improvements on both side of Chenal Parkway and the north side of Highway 10 adjacent to this subdivision. Subsection c. On Cantrell Road, a 55 foot right of way from centerline or of sufficient width for intersection improvements to the Master Street Plan will be dedicated to the City of Little Rock prior to approval of the final plat and on Chenal Parkway, a 45 foot right of way from ORDINANCE Deferral for Chenal and Highway 10 [PAGE 1 OF 2] 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 centerline or of sufficient width for intersection improvements to the Master Street Plan wilt be dedicated to the City of Little Rock prior to approval of the final plat. Section 2. Severability. In the event any portion of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of this ordinance, which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional was not originally a part of this ordinance. Section 3. Repealer. All ordinances and resolutions, and parts thereof, which are in conflict with any provision of this ordinance are hereby repealed to the extent of such conflict. Section 4.
