12616RESOLUTION NO. 12,616 2 3 A RESOLUTION TO AUTHORIZE THE EXECUTION OF AN 4 AMENDMENT TO THE INTERLOCAL AGREEMENT FOR MEMS 5 AMBULANCE SERVICE BETWEEN THE CITIES OF LITTLE ROCK, 6 ARKANSAS AND LONOKE, ARKANSAS, TO PROVIDE FOR A SUBSIDY 7 FOR AMBULANCE SERVICE IN LONOKE; OR, IN THE ALTERNATIVE, 8 TO GIVE NOTICE OF TERMINATION OF AMBULANCE SERVICES; 9 AND FOR OTHER PURPOSES. 10 11 WHEREAS, the Little Rock Ambulance Authority d /b /a Metropolitan Emergency 12 Medical Services ( "MEMS ") has experienced a significant reduction in Medicare 13 reimbursement for ambulance services beginning in 2002; and 14 WHEREAS, MEMS will receive $1.4 million dollars less in 2008 than would have 15 been the case had the rules not changed; and 16 WHEREAS, MEMS has identified projected direct costs of operations in each 17 part of its service area and also assigned a portion of the indirect overhead costs 18 allocated by run volume; then compared such costs to the expected revenue in each 19 community for 2008; and 20 WHEREAS, when the expected costs exceed the expected revenues, the 21 difference is the amount of the subsidy. 22 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE 23 CITY OF LITTLE ROCK, ARKANSAS: 24 Section 1. The Board hereby authorizes the Mayor and City Clerk to execute 25 amendments to the existing interlocal agreement for MEMS Ambulance Service with 26 the City of Lonoke, Arkansas to provide for payment of a subsidy to MEMS to cover 27 costs for their service area. The subsidy for 2008 will be $87,571. This commitment 28 to pay must be made by January 1, 2008. Should Lonoke not be able to fund the 29 subsidy, the Mayor is hereby directed to give 120 days notice of termination of MEMS' 30 ambulance services to the City of Lonoke. The Cities are further authorized to [PAGE 1 of 2] Resolution Interlocal Agreement between the City of Little Rock, Arkansas and Lonoke I negotiate a pro -rata monthly subsidy until a new ambulance services provider can 2 establish operations. 3 Section 2. Severability. In the event any portion of this resolution is 4 declared or adjudged to be invalid or unconstitutional, such declaration or 5 adjudication shall not affect the remaining portions of this resolution, which shall 6 remain in full force and effect as if the portion so declared or adjudged invalid or 7 unconstitutional was not originally a part of this resolution. 8 Section 3. Repealer. All ordinances and resolutions, and parts thereof, which 9 are in conflict with any provision of this resolution are hereby repealed to the extent 10 of such conflict. 11 ADOPTED: November 20, 2007 12 ATTEST: APPROVED: 13 14 15 Nat ki S.
