12586I RESOLUTION NO. 12,586 2 3 A RESOLUTION TO AUTHORIZE THE ACCEPTANCE OF 0.12 ACRES OF LAND 4 FROM HEIFER PROJECT INTERNATIONAL TO BE USED FOR CONSTRUCTION OF 5 AN EXTENSION TO 3RD STREET; AND FOR OTHER PURPOSES. 6 7 WHEREAS, the previous closure of 2"d Street limited the vehicular access East of Interstate 30, 8 making it necessary to extend 3rd Street to Shall Street, and 9 WHEREAS, the location and development of the headquarters of Heifer Project International and 10 subsequent generation of a significant volume of traffic in the immediate area made it necessary to 11 construct the street system to accommodate the demand, which has been accomplished, and 12 WHEREAS, Heifer Project International is the owner of 0.12 acres of land, more fully described in 13 Section 1 below, that Heifer in error believed it had already dedicated to the City of Little Rock for the 14 construction of the extension to 3rd Street, and 15 WHEREAS, Heifer Project International is willing to quitclaim the referenced property to the City 16 in exchange for monetary consideration of Ten Dollars ($10.00) and the City Board of Directors has 17 determined the acquisition of the property to be in the best interests of the City. 18 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE 19 ROCK, ARKANSAS: 20 Section1. The City of Little Rock, Arkansas hereby accepts dedication of the land described below, 21 by quitclaim deed, a copy of which is attached hereto as Attachment A (the "Deed "): 22 23 A part of Wiggin's It Yonley Addition to the City of Little Rock, County of Pulaski, State 24 of Arkansas and being more particularly described as follows: Beginning Southeast 25 corner of Block 2 of the Rectortown Addition to the City of Little Rock; thence 26 S77 °03'38 "E 60.57', thence S87 °33'58 "E 317.32', thence NO2 °13'50 "E 13.43', thence 27 S86° 31'42 "E 42.01', thence S88'1 5'09"E 81.70', thence S01 °08'10 "W 60.00' to a point 28 on the south ROW of 3rd Street, with said ROW S88 °15'09 "E 174.73' to the point of 29 beginning. A copy of this resolution, duly certified by the City Clerk, along with an executed copy of the Deed shall be filed in the Office of Clerk and Recorder of Pulaski County at Little Rock, Arkansas, and recorded in the deed records of Pulaski County, Arkansas. Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the resolution which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the resolution. Section 4. Repealer. All laws, ordinances, resolutions, or parts of the same, that are inconsistent with the provisions of this resolution, are hereby repealed to the extent of such inconsistency.
